25 LC 55 0367 House Bill 204 By: Representatives Washburn of the 144th, Powell of the 33rd, Ridley of the 6th, Ridley of the 22nd, and Ehrhart of the 36th A BILL TO BE ENTITLED AN ACT To amend Part 2 of Article 3 of Chapter 1 of Title 40 of the Of ficial Code of Georgia1 Annotated, relating to certification of motor carriers, so as t o repeal the authority of the2 Department of Public Safety to establish reasonable rates, fare s, and charges for3 transportation by motor carriers of household goods; to provide for related matters; to repeal4 conflicting laws; and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 Part 2 of Article 3 of Chapter 1 of Title 40 of the Official Co de of Georgia Annotated,8 relating to certification of motor carriers, is amended by repe aling in its entirety Code9 Section 40-1-118, relating to establishment of rates, fares, and charges for transportation of10 household goods, and designating said Code section as reserved.11 SECTION 2.12 Said part is further amended by revising Code Section 40-1-119, relating to charges by motor13 carriers and unjust discrimination by carriers prohibited, as follows:14 H. B. 204 - 1 - 25 LC 55 0367 "40-1-119.15 No motor carrier of household goods or passengers shall charge, demand, collect, or16 receive a greater or lesser or different compensation for the t ransportation of household17 goods or passengers or for any service rendered in connection therewith than the rates,18 fares, and charges prescribed or approved by order of the department; nor shall any such19 motor carrier unjustly discriminate against any person in its r ates, fares, or charges for20 service. The commissioner may prescribe, by general order, to what persons motor carriers21 of passengers may issue passes or free transportation; may pres cribe reduced rates for22 special occasions; and may fix and prescribe rates and schedules."23 SECTION 3.24 All laws and parts of laws in conflict with this Act are repealed.25 H.
