25 LC 39 4554 House Bill 257 By: Representatives Williamson of the 112 th, Blackmon of the 146 th, Kelley of the 16 th, Prince of the 132nd, Hilton of the 48th, and others A BILL TO BE ENTITLED AN ACT To amend Article 2A of Chapter 2 of Title 40 of the Official Co de of Georgia Annotated,1 relating to registration and licensing of fleet vehicles, so as to provide for the issuance of2 metal fleet motor vehicle license plates to certain owners prior to registration of a vehicle;3 to provide for application for the issuance of such license pla tes; to provide for the4 development of a system by the Department of Revenue that enables certain owners to assign5 and register fleet vehicles; to provide for definitions; to pro vide for related matters; to6 provide for an effective date; to repeal conflicting laws; and for other purposes.7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:8 SECTION 1.9 Article 2A of Chapter 2 of Title 40 of the Official Code of Geo rgia Annotated, relating to10 registration and licensing of fleet vehicles, is amended by adding a new Code section to read11 as follows:12 "40-2-53.1.13 (a) As used in this Code section, the term:14 H. B. 257 - 1 - 25 LC 39 4554 (1) 'Eligible rental vehicle fleet owner' means a corporation or firm enrolled in a fleet15 registration plan pursuant to this article and which is certified as a rental motor vehicle16 concern by the commissioner.17 (2) 'Rental motor vehicle concern' shall have the same meaning as set forth in Code18 Section 48-5C-1.19 (b) Within 15 days of receipt of a proper application by an el igible rental vehicle fleet20 owner for the issuance of metal fleet motor vehicle license pla tes prior to vehicle21 registration upon a form and in a manner determined by the commissioner, the department22 shall provide such applicant with metal fleet motor vehicle license plates for the operation23 of vehicles in a fleet enrolled pursuant to this article.24 (c) The department shall develop and provide a system for the assignment and registration25 of motor vehicles by an eligible rental vehicle fleet owner fro m the metal fleet motor26 vehicle license plates provided pursuant to this Code section.27 (d) An eligible rental vehicle fleet owner issued metal fleet motor vehicle license plates28 pursuant to this Code section shall ensure the metal fleet motor vehicle license plates are29 securely stored. The license plates issued pursuant to this Code section shall be revoked30 and confiscated upon a determination after a hearing that an el igible rental vehicle fleet31 owner failed to comply with the requirements of this subsection."32 SECTION 2.33 This Act shall become effective upon its approval by the Governor or upon its becoming law34 without such approval.35 SECTION 3.36 All laws and parts of laws in conflict with this Act are repealed.37 H.
