25 LC 61 0100 Senate Bill 104 By: Senators Anavitarte of the 31st, Albers of the 56th, Gooch of the 51st, Walker III of the 20th, Robertson of the 29th and others A BILL TO BE ENTITLED AN ACT To amend Chapter 29 of Title 50 of the Official Code of Georgia Annotated, relating to1 information technology relative to state government, so as to prohibit the use or installation2 of any artificial intelligence system on state equipment when the company that developed or3 deployed such artificial intelligence system is associated with the People's Republic of China;4 to provide definitions; to provide for related matters; to repeal conflicting laws; and for other5 purposes.6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7 SECTION 1.8 Chapter 29 of Title 50 of the Official Code of Georgia Annotate d, relating to information9 technology relative to state government, is amended by adding a new article to read as10 follows:11 "ARTICLE 312 50-29-30.13 As used in this article, the term:14 S. B. 104 - 1 - 25 LC 61 0100 (1) 'Agency' means the State of Georgia and any branch, department, agency, division,15 board, bureau, entity, official, employee, or agent of the stat e and any county,16 municipality, school district, consolidated government, or auth ority created by or17 pursuant to the Constitution of the State of Georgia or any gen eral or local law of this18 state and any official, employee, or agent of any such entity.19 (2) 'Artificial intelligence system' means an engineered or ma chine based system that20 emulates the capability of a person to receive audio, visual, t ext, or any other form of21 information and use the information received to emulate a human cognitive process,22 including, but not limited to, learning, generalizing, reasonin g, planning, predicting,23 acting, or communicating; provided, however, that artificial in telligence systems may24 vary in the forms of information they can receive and in the human cognitive processes25 they can emulate.26 50-29-31.27 No agency shall install or use any artificial intelligence syst em on state equipment if the28 company that developed or deployed such artificial intelligence system is directly or29 indirectly owned or operated by the People's Republic of China or is domiciled in, has its30 principal place of business in, has headquarters in, or is orga nized under the laws of the31 People's Republic of China."32 SECTION 2.33 All laws and parts of laws in conflict with this Act are repealed.34 S.
