HB323: HB323 Bridging the Gap for ALS and Chronic Kidney Disease Act of 2025; enact

26 LC 46 1536S The Senate Committee on Insurance and Labor offered the following substitute to HB 323: A BILL TO BE ENTITLED AN ACT To amend Chapter 3 of Title 33 of the Official Code of Georgia Annotated, relating to1 authorization and general requirements for transaction of insur ance, so as to provide for a2 benefit provider to disclose certain payments to a treating healthcare provider; to provide for3 definitions; to provide for related matters; to provide for an effective date; to repeal4 conflicting laws; and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 Chapter 3 of Title 33 of the Official Code of Georgia Annotated, relating to authorization and8 general requirements for transaction of insurance, is amended by adding a new Code section9 to read as follows:10 "33-3-28.1.11 (a) As used in this Code section, the term:12 (1) 'Benefit provider' means any insurer, health maintenance organization, health benefit13 plan, preferred provider organization, employee benefit plan, o r other entity which14 provides for payment or reimbursement of healthcare expenses, h ealthcare services,15 - 1 - 26 LC 46 1536S disability payments, lost wage payments, or any other benefits under a policy of16 insurance or contract with an individual or group.17 (2) 'Injured party' means a person who alleges that he or she has been injured by the acts18 or omissions of a third party and who has received payments or reimbursements from a19 benefit provider. Such term also includes the personal representative of the estate of such20 person.21 (3) 'Treating healthcare provider' means a person duly licensed or legally authorized to22 provide healthcare services in this state and who has provided such services to an injured23 party.24 (b) Within 30 days of a written request from a treating health care provider, a benefit25 provider shall provide to such treating healthcare provider a written accounting of any and26 all payments and reimbursements made to an injured party for su ch treating healthcare27 provider's healthcare services to such injured party."28 SECTION 2.29 This Act shall become effective upon its approval by the Governor or upon its becoming law30 without such approval.31 SECTION 3.32 All laws and parts of laws in conflict with this Act are repealed.33 - 2 -
