25 LC 39 4501 House Bill 368 By: Representatives Sharper of the 177th, Hitchens of the 161st, Lumsden of the 12th, Neal of the 79th, Cummings of the 39th, and others A BILL TO BE ENTITLED AN ACT To amend Article 1 of Chapter 1 of Title 40 of the Official Cod e of Georgia Annotated,1 relating to general provisions relative to identification and regulation of motor vehicles, so2 as to require a law enforcement officer making a traffic stop to provide the operator with the3 purpose of the stop upon request after such operator displays h is or her driver's license; to4 provide for a short title; to provide for related matters; to r epeal conflicting laws; and for5 other purposes.6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7 SECTION 1.8 This Act shall be known and may be cited as the "De-escalation Right To Know Law."9 SECTION 2.10 Article 1 of Chapter 1 of Title 40 of the Official Code of Geor gia Annotated, relating to11 general provisions relative to identification and regulation of motor vehicles, is amended by12 adding a new Code section to read as follows:13 H. B. 368 - 1 - 25 LC 39 4501 "40-1-10.14 Upon request from the operator of a vehicle stopped by a law en forcement officer for a15 traffic related offense, a law enforcement officer shall provid e such operator with the16 purpose of the stop and suspected traffic law violation, provid ed that such operator first17 displays his or her driver's license pursuant to Code Section 4 0-5-29. Failure by a law18 enforcement officer to comply with this Code section shall not invalidate an otherwise19 lawful arrest or prevent the issuance of a uniform traffic citation."20 SECTION 3.21 All laws and parts of laws in conflict with this Act are repealed.22 H.
