25 LC 44 3063 Senate Resolution 202 By: Senators Harrell of the 40th, Davenport of the 17th, Jackson of the 41st, Anderson of the 43rd, Parent of the 44th and others A RESOLUTION To commemorate the Equal Rights Amendment as the law of the land; to ratify a proposed1 Amendment to the United States Constitution; and for other purposes.2 WHEREAS, the Equal Rights Amendment (ERA), which ensures equality under the law and3 ends discrimination on account of sex, has been ratified by the necessary states and4 confirmed as part of the United States Constitution; and5 WHEREAS, both houses of the 92nd Congress of the United States of America, by a6 constitutional majority of two-thirds, adopted the following resolution proposing to amend7 the United States Constitution:8 RESOLVED BY THE SENATE AND HOUSE OF REPRESENTATIVES OF THE9 UNITED STATES OF AMERICA IN CONGRESS ASSEMBLED (TWO-THIRDS OF10 EACH HOUSE CONCURRING THEREIN), That the following article is proposed as11 an amendment to the Constitution of the United States, which shall be valid to all intents12 and purposes as part of the Constitution when ratified by the legislatures of three-fourths13 of the several States within seven years from the date of its submission by the Congress:14 ARTICLE.......15 S. R. 202 - 1 - 25 LC 44 3063 Section 1. Equality of rights under the law shall not be denied or abridged by the United16 States or by any State on account of sex.17 Section 2. The Congress shall have the power to enforce, by appropriate legislation, the18 provisions of this article.19 Section 3. This amendment shall take effect two years after the date of ratification; and20 WHEREAS, on January 17, 2025, President Joe Biden declared that the Equal Rights21 Amendment is officially the 28th Amendment to the United States Constitution; and22 WHEREAS, the ratification of the ERA is a long-awaited and monu mental victory in the23 advancement of equal rights for American women, marking the fulfillment of a promise to24 secure equal rights for all women under the law; and25 WHEREAS, this achievement reflects decades of tireless advocacy and activism by26 individuals and organizations, who have fought relentlessly for the passage of the ERA; and27 WHEREAS, the ERA guarantees that no individual shall be denied or abridged of their rights28 based on sex, strengthening the protections of liberty and just ice for all enshrined in our29 Constitution; and30 WHEREAS, the passage of the ERA is an affirmation of the United States' commitment to31 human rights, equality, and the pursuit of justice for all; and32 WHEREAS, the ratification of the ERA strengthens our nation's commitment to eliminate33 the unjust discrimination against women in all areas of life, i ncluding but not limited to34 employment, education, healthcare, and in the home; and35 S. R. 202 - 2 - 25 LC 44 3063 WHEREAS, the United States joins the leading countries of the w orld in codifying equal36 rights for all women; and37 WHEREAS, the General Assembly of Georgia acknowledges the ratif ication of the Equal38 Rights Amendment and its confirmation as part of the Constituti on of the United States,39 celebrates the achievement of this milestone, recognizes the on going work of those who40 advocated for equal rights for all Americans, and commits to continuing efforts to support41 and implement the values of fairness, equality, and justice for all under the law; and42 WHEREAS, the General Assembly of Georgia finds that the propose d amendment is43 meaningful as part of the Constitution of the United States and that the present political,44 social, and economic conditions demonstrate that constitutional equality for women and men45 continues to be a timely issue in the United States.46 NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL ASSEMBLY OF47 GEORGIA that the said Amendment to the Constitution of the Unit ed States is hereby48 ratified and adopted.49 BE IT FURTHER RESOLVED that a certified copy of this resolution be forwarded by the50 Governor to the President of the United States, the Secretary of State of the United States,51 and the Archivist of the United States at the National Archives and Records Administration,52 pursuant to 1 U.S.C. Code Section 106b and 112, which shall serve as official notice that the53 proposed amendment to the Constitution of the United States of America is hereby ratified54 by the Georgia General Assembly.55 S.
