26 LC 39 4980S The House Committee on Natural Re sources and Environment offers the following substitute to HB 663: A BILL TO BE ENTITLED AN ACT To amend Code Section 12-9-46 of the Official Code of Georgia A nnotated, relating to1 powers and duties of Board of Natural Resources, designation of commissioner or director2 as board's agent, and power and duties of director, so as to revise provisions relating to the3 fee for motor vehicle emissions inspections; to provide for rel ated matters; to repeal4 conflicting laws; and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 Code Section 12-9-46 of the Official Code of Georgia Annotated, relating to powers and8 duties of Board of Natural Resources, designation of commission er or director as board's9 agent, and power and duties of director, by revising paragraph (9) of subsection (a) as10 follows:11 "(9) To prescribe by rule or regulation fees to be charged by emission inspection stations12 for the performance of emission inspections; provided, however, that such fee shall be13 no less than $10.00 and no more than $25.00 $35.00 per inspection and shall be based on14 the cost of performing such inspection in an adequate and prope r manner including,15 without limitation, the cost of equipment, testing, labor, trai ning, record keeping,16 reporting, and other overhead expenses and may be adjusted annually to reflect the annual17 H. B. 663 (SUB) - 1 - 26 LC 39 4980S rate of inflation or deflation as measured by the Consumer Price Index, or its successor18 or appropriate replacement index, if any, published by the Bureau of Labor Statistics of19 the United States Department of Labor;20 SECTION 2.21 All laws and parts of laws in conflict with this Act are repealed.22 H.
