25 LC 39 4685 House Bill 705 By: Representatives Adesanya of the 43rd, McClain of the 109th, and Ridley of the 22nd A BILL TO BE ENTITLED AN ACT To amend Article 1 of Chapter 1 of Title 40 of the Official Cod e of Georgia Annotated,1 relating to general provisions relative to identification and regulation of motor vehicles and2 traffic, so as to prohibit a motor vehicle traffic stop on the sole basis that the person is3 operating a motorcycle or wearing motorcycle related paraphernalia; to provide for related4 matters; to repeal conflicting laws; and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 Article 1 of Chapter 1 of Title 40 of the Official Code of Geor gia Annotated, relating to8 general provisions relative to identification and regulation of motor vehicles and traffic, is9 amended by adding a new Code section to read as follows:10 "40-1-10.11 A police officer may, upon reasonable articulable suspicion that a motor vehicle is being12 operated in violation of any provision of this title, stop or d etain such vehicle. A traffic13 stop based on a reasonable articulable suspicion predicated solely on the fact that a person14 is operating a motorcycle or wearing motorcycle related paraphernalia shall be unlawful."15 H.
