A BILL TO BE ENTITLED
AN ACT
To amend Code Section 10-1-393.3 of the Official Code of Georgia Annotated, relating to1
prohibited use of purchaser's credit card information by merchant, so as to limit the amount2
of surcharges charged by merchants for purchasers using credit cards; to provide for related3
matters; to repeal conflicting laws; and for other purposes.4
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:5
SECTION 1.6
Code Section 10-1-393.3 of the Official Code of Georgia Annotated, relating to prohibited7
use of purchaser's credit card information by merchant, is amen ded by adding a new8
subsection to read as follows:9
"(d.1) A merchant shall be prohibited from requiring a purchase r using a credit card for10
any transaction to pay a surcharge in an amount that exceeds the actual cost to the merchant11
to process the transaction."12
SECTION 2.13
All laws and parts of laws in conflict with this Act are repealed.14
