25 LC 60 0126 House Bill 727 By: Representatives Williamson of the 112th, Efstration of the 104th, Leverett of the 123rd, Gaines of the 120th, and Reeves of the 99th A BILL TO BE ENTITLED AN ACT To amend Part 1 of Article 3 of Chapter 5 of Title 50 of the Of ficial Code of Georgia1 Annotated, relating to general authority, duties, and procedure s of the Department of2 Administrative Services in state purchasing, so as to provide a post-employment restriction3 for state employees involved in state purchasing; to provide for related matters; to provide4 for an effective date and applicability; to repeal conflicting laws; and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 Part 1 of Article 3 of Chapter 5 of Title 50 of the Official Co de of Georgia Annotated,8 relating to general authority, duties, and procedures of the De partment of Administrative9 Services in state purchasing, is amended by adding a new Code section to read as follows:10 "50-5-86.11 (a) As used in this Code section, the term:12 (1) 'Employment' includes consulting or other independent contractor services.13 (2) 'Participates' means involvement in decision-making processes related to developing,14 negotiating, evaluating, awarding, or managing contracts for goods or services on behalf15 of a state agency.16 H. B. 727 - 1 - 25 LC 60 0126 (3) 'State agency' means any department, agency, board, commission, or authority of the17 state, or any political subdivision thereof.18 (b) Any employee of a state agency who participates in the sol icitation, negotiation, or19 administration of contracts for goods or services for such state agency shall be prohibited20 from accepting employment with any vendor or contractor involving such contracts for a21 period of 12 months following the termination of his or her emp loyment with the state22 agency."23 SECTION 2.24 (a) This Act shall become effective upon its approval by the Governor or upon its becoming25 law without such approval.26 (b) This Act shall apply to any employment starting on or after the effective date of this Act,27 and to any renewals, modifications, or extensions of such emplo yment starting on or after28 such date.29 SECTION 3.30 All laws and parts of laws in conflict with this Act are repealed.31 H.
