25 LC 49 9005 House Bill 918 By: Representatives Hilton of the 48th and Jones of the 25th A BILL TO BE ENTITLED AN ACT To amend Part 13 of Article 6 of Chapter 2 of Title 20 of the O fficial Code of Georgia1 Annotated, relating to organization of schools and systems unde r the "Quality Basic2 Education Act," so as to permit private school students, home study students, and nonresident3 public school students to enroll as part-time students in any public school in this state, subject4 only to enrolling school capacity and academic and grade level prerequisites; to provide for5 schools enrolling such students to receive state funds; to proh ibit tuition; to provide for6 policies, rules, and regulations; to provide for definitions; to provide for related matters; to7 repeal conflicting laws; and for other purposes.8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:9 SECTION 1.10 Part 13 of Article 6 of Chapter 2 of Title 20 of the Official C ode of Georgia Annotated,11 relating to organization of schools and systems under the "Quality Basic Education Act," is12 amended by adding a new Code section to read as follows:13 "20-2-297.14 (a) As used in this Code section, the term:15 H. B. 918 - 1 - 25 LC 49 9005 (1) 'Home study student' means a student in a home study progr am which meets the16 requirements of subsection (c) of Code Section 20-2-690.17 (2) 'Parent' means a parent, legal guardian, custodian, or other person with legal authority18 to act on behalf of a student.19 (3) 'Part-time student' means a student enrolling in a public school on a less than full time20 basis. 21 (4) 'Private school student' means a student in a private scho ol which meets the22 requirements of subsection (b) of Code Section 20-2-690.23 (5) 'Resident school' means the school in which a student is or would be enrolled based24 on his or her residence.25 (b) A parent of a home study student or a private school stude nt shall be permitted to26 enroll such student in any public school in this state on a part-time basis to attend academic27 courses offered by such public school.28 (c) A student enrolled in a public school in this state shall be permitted to enroll in any29 other public school in this state on a part-time basis to access courses and other academic30 and school based services and programs currently unavailable to such student at his or her31 resident school.32 (d)(1) A local school system shall earn state funds for each home study student, private33 school student, or nonresident public school student enrolled i n one or more courses34 pursuant to this Code section. Such funds shall be earned in a ccordance with Code35 Section 20-2-160 for any one-sixth segment of the day or its block scheduling equivalent36 that each such part-time student attends, or in accordance with State Board of Education37 guidelines established for such purpose.38 (2) A local board of education shall not charge part-time stude nts enrolled as provided39 for in this Code section.40 (e) Each local board of education shall adopt such policies, r ules, and regulations41 necessary to implement and consistent with the purpose and inte nt of this Code section.42 H. B. 918 - 2 - 25 LC 49 9005 The only enrollment criteria that may be applied to restrict th e enrollment of part-time43 students as provided for in this Code section shall be academic or grade level prerequisites44 and enrollment capacity at the enrolling school."45 SECTION 2.46 All laws and parts of laws in conflict with this Act are repealed.47 H.
