The House Committee on Judiciary, Juvenile offers the following substitute to HB 1429:
A BILL TO BE ENTITLED
AN ACT
To amend Code Section 15-11-64 of the Official Code of Georgia Annotated, relating to
collection of information by juvenile court clerks, reporting requirement, and data collection,
so as to require that juvenile court clerks collect and submit data regarding monetary
sanctions assessed for juvenile offenders to the Administrative Office of the Courts; to
provide for reporting requirements; to provide for related matters; to repeal conflicting laws;
and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
Code Section 15-11-64 of the Official Code of Georgia Annotated, relating to collection of
information by juvenile court clerks, reporting requirement, and data collection, is amended
by adding new subsections to read as follows:
<ins>"(e) Each clerk of the juvenile court shall collect the following information for each child
in need of services, delinquent child, and child accused of a misdemeanor or felony offense
and shall provide to the Administrative Office of the Courts in a form and format specified
by the Administrative Office of the Courts and incorporated into the Georgia Juvenile Data
</ins>
<ins>Exchange or any such successor database maintained by the Administrative Office of the
Courts such information:
(1) Sex;
(2) Age;
(3) Race;
(4) Offense charged;
(5) Location of the offense, including whether the offense occurred in a school safety
zone, as such term is defined in Code Section 16-11-127.1;
(6) The name of the referral source, including the name of the school district if the
referring source was a school;
(7) Disposition of the case, including any monetary sanctions which may include, but are
not limited to, fines, fees, court costs, and restitution;
(8) Sentence imposed, including the type and amount of monetary sanctions such as
fines, court costs, and restitution;
(9) Court of jurisdiction; and
(10) The collection status of any monetary sanctions.
(f) All such data elements shall be submitted through a regular scheduled data upload into
the Georgia Juvenile Data Exchange at the maximum frequency allowed by local case
management system parameters; provided, however, that such upload shall occur no less
than once per week. The Administrative Office of the Courts shall compile all data
collected pursuant to subsection (e) of this Code section by April 15, 2027, and annually
thereafter. The compiled data report shall be made publicly available and incorporated into
the Georgia Juvenile Data Exchange."
