A BILL TO BE ENTITLED
AN ACT
To amend Part 2A of Article 13 of Chapter 6 of Title 40 of the Official Code of Georgia
Annotated, relating to electric personal assistive mobility devices and personal delivery
devices, so as to revise operation procedures and restrictions for personal delivery devices;
to provide for related matters; to repeal conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
Part 2A of Article 13 of Chapter 6 of Title 40 of the Official Code of Georgia Annotated,
relating to electric personal assistive mobility devices and personal delivery devices, is
amended by revising Code Section 40-6-321, relating to avoiding collisions, yielding the
right of way, and warning of approach, as follows:
"40-6-321.
Any person operating an electric personal assistive mobility device or a personal delivery
device on a sidewalk or roadway shall comply with the requirements of this part or any
local ordinance regulating the use of such devices pursuant to Code Section 40-6-371 and
shall exercise due care to avoid colliding with, and shall yield the right of way to, persons
traveling on foot. A personal delivery device shall emit a sound when <del>approaching</del> <ins>in
motion</ins> and within six feet of a vehicle, person on foot, or individual in a wheelchair."
SECTION 2.
Said part is further amended in Code Section 40-6-322, relating to speed of travel restricted,
by revising subsection (b) as follows:
"(b) Operation of a personal delivery device shall be limited to:
(1) A speed of no greater than 20 miles per hour when upon a bicycle lane, shoulder, or
roadway;
(2) A speed of no greater than <del>four</del> <ins>seven</ins> miles per hour when upon a sidewalk or within
a shared use path or safety zone; and
(3) A speed of no less than 3.5 feet per second and no more than <del>four</del> <ins>seven</ins> miles per
hour when within a crosswalk."
SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
