House Resolution 1751
By: Representatives Lewis-Ward of the 115th, Hugley of the 141st, Greene of the 154th,
Wilkerson of the 38th, and Powell of the 33rd
A RESOLUTION
Urging condominium associations, property owners' associations, and any other corporations
or voluntary entities formed for the purpose of exercising the powers of a homeowners' or
property owners' association governing a common interest community to provide
transparency to members of such associations; and for other purposes.
WHEREAS, ownership of a condominium or single-family home represents the fulfillment
of the American dream and a significant investment in a person's financial future; and
WHEREAS, many condominiums and single-family homes are located in condominium
associations, property owners' associations, and other corporations or voluntary entities
formed for the purpose of exercising the powers of a homeowners' or property owners'
association governing a common interest community; and
WHEREAS, such associations may levy assessments, special assessments, and other fees on
members; and
WHEREAS, purchasers of properties in such associations may not know their properties are
burdened by assessments, special assessments, or other fees; and
WHEREAS, members of such associations may not be aware they owe such assessments,
special assessments, or other fees or that such assessments, special assessments, or other fees
have not been paid; and
WHEREAS, such associations should provide contact information for requests for statement
of account in an easy to find location on its public website or made available to members and
promptly providing detailed statements of account to members upon request listing
assessments, due dates for assessments, any assessments due to such associations, and any
scheduled assessments that will become due to avoid the potential consequence of a member
losing his or her home for not paying assessments and other fees.
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES that
the members of this body urge condominium associations, property owners' associations, and
any other corporations or voluntary entities formed for the purpose of exercising the powers
of a homeowners' or property owners' association governing a common interest community
to provide transparency to members of such associations.
BE IT FURTHER RESOLVED that such associations are urged to provide contact
information for requests for statement of account in an easy to find location on its public
website or made available to members and promptly providing detailed statements of account
to members upon request listing assessments, due dates for assessments, any assessments due
to such associations, and any scheduled assessments that will become due.
BE IT FURTHER RESOLVED that the Clerk of the House of Representatives is authorized
and directed to make appropriate copies of this resolution available for distribution to the
public and the press.

## Summaries written by Georgia Commons

The following was written by claude-sonnet-5 from the text above and is not part of the resolution. Quote the text, not the summary.

A Georgia House resolution urges condominium and property owners' associations to be more transparent with members about assessments, fees, and account statements. It does not create any new legal requirement.

### Plain-language summary

This resolution addresses a common concern among Georgia homeowners: many people who live in condominiums or homes governed by property owners' associations do not always know what fees or assessments they owe, or that unpaid fees could put their homes at risk. The resolution notes that these associations can charge assessments and special fees, and that members sometimes are not told clearly when they owe money or that a payment is overdue.
Rather than changing Georgia law, the resolution urges condominium associations, property owners' associations, and similar entities to make it easier for members to find contact information for requesting an account statement, either on their website or otherwise available to members. It also urges these associations to promptly provide members with detailed statements listing current assessments, due dates, amounts owed, and upcoming assessments. The resolution directs the Clerk of the House to distribute copies to the public and press, but it creates no enforceable obligation.

### What it does

- Urges condominium associations and property owners' associations to be more transparent with members about fees and assessments, without creating a legal mandate.
- Asks these associations to post contact information for requesting an account statement in an easy to find spot on their website or otherwise make it available to members.
- Asks these associations to promptly give members detailed statements listing current assessments, due dates, amounts owed, and upcoming assessments.
- Directs the Clerk of the House of Representatives to distribute copies of the resolution to the public and the press.

### Who it affects

Homeowners and condominium owners who belong to condominium associations, property owners' associations, or similar homeowner governance entities in Georgia, as well as the associations themselves, which are the target of the resolution's requests for greater transparency.

### Why it matters

Homeowners sometimes lose track of assessments or special fees owed to their association, which can lead to serious consequences including risk of losing their home. This resolution highlights that problem and asks associations to voluntarily improve communication, though it does not require them to change their practices.

### Key provisions

- The preamble explains that association members may not know their properties carry unpaid assessments or fees, sometimes risking loss of their home.
- The first resolving clause urges associations to provide transparency to members generally.
- The second resolving clause specifically urges associations to post easy to find contact information for account statement requests and to promptly provide detailed statements listing assessments, due dates, and amounts owed.
- The final clause directs the Clerk of the House to make copies available to the public and press; the resolution imposes no binding legal duty.
