A RESOLUTION

Urging the Rockdale County Board of Commissioners to exercise the power given to them under current law and appoint members to the vacant seats on the Rockdale County Water and Sewerage Authority, including any seats held by holdover members; and for other purposes.

WHEREAS, an Act to create the Rockdale County Water and Sewerage Authority (Ga. L. 1995, p. 3994) provides that such authority shall be governed by a seven member board to be appointed by the Rockdale County Board of Commissioners; and

WHEREAS, for a number of years the Rockdale County Board of Commissioners has failed to appoint members to the Rockdale County Water and Sewerage Authority following the expiration of the terms of prior authority members; and

WHEREAS, the failure to appoint new members has left some of the authority's seats vacant and left other seats occupied by holdover members for years beyond the expiration of their original terms; and

WHEREAS, the Rockdale County Board of Commissioner's failure to keep the authority's board filled with current appointees has created great confusion and potential legal liability for the authority and the county; and

WHEREAS, the citizens of Rockdale County deserve to be fully represented by current appointees to the Rockdale County Water and Sewerage Authority's board.

NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES that the members of this body urge the Rockdale County Board of Commissioners to exercise the power given to them under current law and appoint members to the vacant seats on the Rockdale County Water and Sewerage Authority, including any seats held by holdover members.

BE IT FURTHER RESOLVED that the Clerk of the House of Representatives is authorized and directed to make appropriate copies of this resolution available for distribution to the Rockdale County Board of Commissioners.
