A RESOLUTION
Recognizing the importance of the Rockdale County Board of Commissioners in exercising
their lawful authority; and for other purposes.
WHEREAS, an Act to create the Rockdale County Water and Sewerage Authority (Ga. L.
1995, p. 3994) provides that such authority shall be governed by a seven member board to
be appointed by the Rockdale County Board of Commissioners; and
WHEREAS, for a number of years the Rockdale County Board of Commissioners has failed
to appoint members to the Rockdale County Water and Sewerage Authority following the
expiration of the terms of prior authority members; and
WHEREAS, the failure to appoint new members has left certain seats on the authority's
board vacant and other seats occupied by holdover members for years beyond the expiration
of their original terms; and
WHEREAS, the failure to maintain a properly constituted board has created significant legal
uncertainty regarding the validity of the authority's official actions and has exposed the
authority and the county to potential legal liability; and
WHEREAS, the citizens of Rockdale County, who depend upon the authority for essential
water and sewerage services, deserve to be fully represented by duly appointed members of
the authority's board; and
WHEREAS, it is in the public interest that local governing authorities exercise their lawful
powers fully, faithfully, and in a timely manner.
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES that
this body recognizes the importance of the Rockdale County Board of Commissioners in
exercising their lawful authority, and urges the board to promptly appoint qualified members
to all vacant seats on the Rockdale County Water and Sewerage Authority, including any
seats presently held by holdover members whose terms have expired.
BE IT FURTHER RESOLVED that the Clerk of the House of Representatives is authorized
and directed to make appropriate copies of this resolution available for distribution to the
Rockdale County Board of Commissioners.
