Senate Bill 390 By: Senators Jones II of the 22nd, Jackson of the 41st, Orrock of the 36th, Parent of the 44th, Rahman of the 5th and others A BILL TO BE ENTITLED AN ACT To amend Part 1 of Article 1 of Chapter 2 of Title 38 of the Official Code of Georgia Annotated, relating to general provisions of state military generally, so as to prohibit the deployment of armed military forces of other states into this state without the permission of the Governor; to provide for an exception; to provide for other matters; to repeal conflicting laws; and for other purposes. BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. Part 1 of Article 1 of Chapter 2 of Title 38 of the Official Code of Georgia Annotated, relating to general provisions of state military generally, is amended by adding a new Code section to read as follows: "38-2-13. (a) No armed military forces from another state, territory, or district shall enter this state for the purpose of performing any military duty without the permission of the Governor. (b) The provisions of subsection (a) of this Code section shall not apply to armed military forces that are in the service of the United States and are acting under authority that is validly invoked by the President of the United States." SECTION 2. All laws and parts of laws in conflict with this Act are repealed.
