A BILL TO BE ENTITLED
AN ACT
To amend Chapter 9 of Title 33 of the Official Code of Georgia Annotated, relating to
regulation of rates, underwriting rules, and related organizations, so as to prohibit vehicle
insurers from using any geographic classifications in vehicle insurance policies; to provide
for related matters; to provide for an effective date and applicability; to repeal conflicting
laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
Chapter 9 of Title 33 of the Official Code of Georgia Annotated, relating to regulation of
rates, underwriting rules, and related organizations, is amended in Code Section 33-9-4,
relating to standards applicable to making and use of rates, by striking "and" at the end of
paragraph (9), by replacing the period with a semicolon at the end of paragraph (10), and by
adding new paragraphs to read as follows:
"(11) No insurer shall base any standard or rating plan on vehicle insurance, in whole or
in part, directly or indirectly, upon any geographic identifier, including, but not limited
to, a ZIP Code, postal code, census tract, neighborhood, municipality, or any other
geographic classification used to group consumers based on location; and
(12) No insurer shall base any denial, refusal to issue, cancellation, nonrenewal, tier
placement, surcharge, or increase in premiums on vehicle insurance, in whole or in part,
directly or indirectly, upon any geographic identifier, including, but not limited to, a ZIP
Code, postal code, census tract, neighborhood, municipality, or any other geographic
classification used to group consumers based on location."
SECTION 2.
This Act shall become effective on January 1, 2027, and shall apply to all vehicle insurance
policies issued, renewed, or modified on or after such date.
SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
