A BILL TO BE ENTITLED
AN ACT
To amend an Act establishing in DeKalb County districts from which members of the county
board of education shall be elected, approved April 12, 1963 (Ga. L. 1963, p. 3424), as
amended, so as to change the description of the education districts; to provide for the election
at large of the chairperson of such board of education; to provide for definitions and
inclusions; to provide for continuation in office of current members; to provide for a
referendum, effective dates, automatic repeal, mandatory execution of election, and judicial
remedies regarding failure to comply; to provide for related matters; to repeal conflicting
laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
An Act establishing in DeKalb County districts from which members of the county board of
education shall be elected, approved April 12, 1963 (Ga. L. 1963, p. 3424), as amended, is
amended by revising Section 1 as follows:
"SECTION 1.
(a) There is created the board of education of DeKalb County. The board of education
shall consist of seven members elected as provided in subsection (b) of this section.
(b) For purposes of electing members of the board of education, the DeKalb County
School District is divided into seven education districts. One member of the board shall
be elected from each such district. Education districts 1, 2, 3, 4, 5, and 6 shall be and
correspond to those six numbered districts described in Appendix A and attached to and
made a part of this Act and further identified as 'User: SD10 Plan Name:
DekSB-SD10-p1-2026 Plan Type: Local'. Education district 7 shall be composed of the
entire geographic area of the DeKalb County School District and the person elected from
such district shall serve as the chairperson of the board of education.
(c) For the purposes of such plan:
(1) The term 'VTD' shall mean and describe the same geographical boundaries as
provided in the report of the Bureau of the Census for the United States decennial census
of 2020 for the State of Georgia. The separate numeric designations in a district
description which are underneath a 'VTD' heading shall mean and describe individual
Blocks within a VTD as provided in the report of the Bureau of the Census for the United
States decennial census of 2020 for the State of Georgia; and
(2) Except as otherwise provided in the description of any district, whenever the
description of any district refers to a named city, it shall mean the geographical
boundaries of that city as shown on the census maps for the United States decennial
census of 2020 for the State of Georgia.
(d) Any part of the DeKalb County School District which is not included in any district
described in subsection (b) of this section shall be included within that district contiguous
to such part which contains the least population according to the United States decennial
census of 2020 for the State of Georgia.
(e) Any part of DeKalb County School District which is described in subsection (b) of this
section as being included in a particular district shall nevertheless not be included within
such district if such part is not contiguous to such district. Such noncontiguous part shall
instead be included within that district contiguous to such part which contains the least
population according to the United States decennial census of 2020 for the State of
Georgia."
SECTION 2.
Those members of the board of education of DeKalb County who are serving as such on the
effective date of this Act and any person selected to fill a vacancy in any such office shall
continue to serve as such members until the regular expiration of their respective terms of
office and upon the election and qualification of their respective successors.
SECTION 3.
The election superintendent of DeKalb County shall call and conduct an election as provided
in this section for the purpose of submitting this Act to the electors of the DeKalb County
school district for approval or rejection. The election superintendent shall conduct that
election on the Tuesday following the first Monday in November, 2026, and shall issue the
call and conduct that election as provided by general law. The election superintendent shall
cause the date and purpose of the election to be published once a week for two weeks
immediately preceding the date thereof in the official organ of DeKalb County. The ballot
shall have written or printed thereon the words:
"( ) YES Shall the Act be approved which provides that the DeKalb County Board of
Education shall be composed of six members elected from one of six
( ) NO election districts and a chairperson elected by the voters of the school
system at large?"
All persons desiring to vote for approval of the Act shall vote "Yes," and all persons desiring
to vote for rejection of the Act shall vote "No." If more than one-half of the votes cast on
such question are for approval of the Act, Sections 1 and 2 of this Act shall become of full
force and effect on January 1, 2029; provided, however, that those provisions of Section 1
necessary to conduct the 2028 election for members of the DeKalb County Board of
Education shall become effective on January 1, 2028. If the Act is not so approved or if the
election is not conducted as provided in this section, Sections 1 and 2 of this Act shall not
become effective, and this Act shall be automatically repealed on the 365th calendar day
following the election date provided for in this section. The expense of such election shall
be borne by DeKalb County. It shall be the election superintendent's duty to certify the result
thereof to the Secretary of State. The provisions of this section shall be mandatory upon the
election superintendent and are not intended as directory. If the election superintendent fails
or refuses to comply with this section, any elector of the DeKalb County school district may
apply for a writ of mandamus to compel the election superintendent to perform his or her
duties under this section. If the court finds that the election superintendent has not complied
with this section, the court shall fashion appropriate relief requiring the election
superintendent to call and conduct such election on the date required by this section or on the
next date authorized for special elections provided for in Code Section 21-2-540 of the
O.C.G.A.
SECTION 4.
Except as otherwise provided in Section 3 of this Act, this Act shall become effective upon
its approval by the Governor or upon its becoming law without such approval.
SECTION 5.
All laws and parts of laws in conflict with this Act are repealed.
