A BILL TO BE ENTITLED
AN ACT
To amend an Act to incorporate the City of Tucker, approved May 12, 2015 (Ga. L. 2015, p. 3897), as amended, so as to provide for the annexation of certain territory into the boundaries of the city; to provide for related matters; to provide for a referendum; to provide for a contingent effective date and automatic repeal; to repeal conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
An Act to incorporate the City of Tucker, approved May 12, 2015 (Ga. L. 2015, p. 3897), as amended, is amended by adding a new section to read as follows: "SECTION 1.02A.
Additions to the corporate boundaries.
(a)(1) In addition to the boundaries provided for in Section 1.02, there shall be included in the boundaries of the city all of the area embraced within the following described tracts and parcels of land:

(2) For the purposes of plan provided for in paragraph (1) of this subsection:
(A) The term "VTD" shall mean and describe the same geographical boundaries as provided in the report of the Bureau of the Census for the United States decennial census of 2020 for the State of Georgia. The separate numeric designations in a district description which are underneath a VTD heading shall mean and describe individual Blocks within a VTD as provided in the report of the Bureau of the Census for the United States decennial census of 2020 for the State of Georgia; and
(B) Except as otherwise provided in the description of any district, whenever the description of any district refers to a named city, it shall mean the geographical boundaries of that city as shown on the census maps for the United States decennial census of 2020 for the State of Georgia.
(b) Reserved."
SECTION 2.
The election superintendent of DeKalb County shall call and conduct a special election as provided in this section for the purpose of submitting this Act to the electors of the territory sought to be annexed into the City of Tucker under this Act for approval or rejection. The election superintendent shall conduct such election on the Tuesday next following the first Monday in November, 2026, and shall issue the call and conduct such election as provided by general law. The election superintendent shall cause the date and purpose of the election to be published once a week for two weeks immediately preceding the date thereof in the official organ of DeKalb County. The ballot shall have written or printed thereon the words: "( ) YES Shall the Act which annexes certain land into the City of Tucker be ( ) NO approved?"
All persons desiring to vote for approval of the annexation shall vote "Yes," and all persons desiring to vote for rejection of the annexation shall vote "No." If more than one-half of the votes cast on such question are for approval of the annexation, then this Act shall become effective on January 1, 2027. If more than one-half of the votes cast on such question are for rejection of the annexation, this Act shall not become effective and shall be automatically repealed on the first day of January immediately following such election date. The expense of such election shall be borne by the City of Tucker. It shall be the election superintendent's duty to certify the result thereof to the Secretary of State.
SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
