A RESOLUTION
Proposing an amendment to the Constitution of the State of Georgia so as to prohibit
mid-decade reapportionment or redistricting of congressional and legislative districts; to
authorize limited remedial plans in the event of a court finding defects in such districts; to
provide for related matters; to provide for the submission of this amendment for ratification
or rejection; and for other purposes.
BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
Article III, Section II of the Constitution is amended by revising Paragraph II as follows:
"Paragraph II. Apportionment of General Assembly. <del>The General Assembly shall
apportion the Senate and House districts. Such districts shall be composed of contiguous
territory. The apportionment of the Senate and of the House of Representatives shall be
changed by the General Assembly as necessary after each United States decennial census.
</del> <ins>The General Assembly, at the first regular session convening after the return of every
decennial census of population taken by order of Congress, shall apportion districts for the
Senate, the House of Representatives and Georgia's delegation to the United States House
of Representatives, and any other state office elected by district. Such districts shall be
composed of contiguous territory. Once established, such districts shall remain unaltered

<ins>until the return of the next subsequent decennial census of population taken by order of
Congress; provided, however, that, if a court of competent jurisdiction finds that one or
more such districts violates this Constitution, or the Constitution of the United States or
federal law, the General Assembly shall have the limited authority to remedy the defects
specifically identified by such court, but otherwise such apportionment or district plan shall
remain unaltered for the time provided for in this Paragraph."
</ins> SECTION 2.
The above proposed amendment to the Constitution shall be published and submitted as
provided in Article X, Section I, Paragraph II of the Constitution. The ballot submitting the
above proposed amendment shall have written or printed thereon the following:
"( ) YES Shall the Constitution of Georgia be amended so as to prohibit mid-decade
( ) NO reapportionment or redistricting of legislative and congressional districts and
to provide for limited remedies if a court finds defects?"
All persons desiring to vote in favor of ratifying the proposed amendment shall vote "Yes."
All persons desiring to vote against ratifying the proposed amendment shall vote "No." If
such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall
become a part of the Constitution of this state.
