HR1008: HR1008 State-wide water management plan; ratify amendments

26 LC 44 3274/AP House Resolution 1008 (AS PASSED HOUSE AND SENATE) By: Representatives Smith of the 70th, Dickey of the 134th, Corbett of the 174th, Townsend of the 179th, and Smith of the 138th A RESOLUTION To ratify amendments to a certain comprehensive state-wide wate r management plan; to1 provide for force and effect; to provide for construction; to p rovide an effective date; to2 repeal conflicting laws; and for other purposes.3 WHEREAS, pursuant to Article 8 of Chapter 5 of Title 12 of the O.C.G.A., the4 Environmental Protection Division of the Department of Natural Resources developed a5 comprehensive state-wide water management plan and submitted such a plan to the Water6 Council for adoption; and7 WHEREAS, the Water Council adopted such a plan on January 8, 2008, and submitted such8 plan to the General Assembly on January 14, 2008, for considera tion by the General9 Assembly under Code Section 12-5-525 of the O.C.G.A.; and10 WHEREAS, the General Assembly ratified such plan as H.R. 1022 and the Governor signed11 such plan, effective February 6, 2008; and12 WHEREAS, the Water Council reconvened on September 29, 2025, to consider amendments13 to the comprehensive state-wide water management plan; and14 H. R. 1008 - 1 - 26 LC 44 3274/AP WHEREAS, the Water Council adopted such amendments to the comprehensive state-wide15 water management plan on December 9, 2025, and submitted those amendments to the16 General Assembly on January 12, 2026, for consideration by the General Assembly under17 Code Section 12-5-525 of the O.C.G.A.; and18 WHEREAS, it is the desire of the General Assembly to ratify such amendments to the plan19 pursuant to Code Section 12-5-525 of the O.C.G.A.20 NOW, THEREFORE, BE IT RESOLVED AND ENACTED BY THE GENERAL21 ASSEMBLY OF GEORGIA:22 (1) That the amendments to the comprehensive state-wide water management plan23 adopted by the Water Council on December 9, 2025, on file in the office of the director24 of the Environmental Protection Division, and submitted to the General Assembly on25 January 12, 2026, are hereby ratified pursuant to Code Section 12-5-525 of the O.C.G.A.;26 (2) That such amended nonstatutory plan shall have force and effect;27 (3) That in the event any provision of such amended nonstatuto ry plan irreconcilably28 conflicts with any current or future statute enacted by the General Assembly, then, to the29 extent of the conflict, the provisions of such statute shall control;30 (4) That this resolution shall become effective upon its approval by the Governor or upon31 its becoming law without such approval; and32 (5) That all laws and parts of laws in conflict with this resolution are repealed.33 H.
