26 LC 39 4860/AP House Bill 986 (AS PASSED HOUSE AND SENATE) By: Representatives Jones of the 25th, Hilton of the 48th, Huddleston of the 72nd, Townsend of the 179th, and Barrett of the 24th A BILL TO BE ENTITLED AN ACT To amend Part 2A of Article 13 of Chapter 6 of Title 40 of the Official Code of Georgia1 Annotated, relating to electric personal assistive mobility dev ices and personal delivery2 devices, so as to revise operation procedures and restrictions for personal delivery devices;3 to provide for related matters; to repeal conflicting laws; and for other purposes.4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:5 SECTION 1.6 Part 2A of Article 13 of Chapter 6 of Title 40 of the Official Code of Georgia Annotated,7 relating to electric personal assistive mobility devices and pe rsonal delivery devices, is8 amended by revising Code Section 40-6-321, relating to avoiding collisions, yielding the9 right of way, and warning of approach, as follows:10 "40-6-321.11 Any person operating an electric personal assistive mobility device or a personal delivery12 device on a sidewalk or roadway shall comply with the requireme nts of this part or any13 local ordinance regulating the use of such devices pursuant to Code Section 40-6-371 and14 shall exercise due care to avoid colliding with, and shall yield the right of way to, persons15 H. A personal delivery device shall emit a sou nd when approaching in16 motion and within six feet of a vehicle, person on foot, or individual in a wheelchair."17 SECTION 2.18 Said part is further amended in Code Section 40-6-322, relating to speed of travel restricted,19 by revising subsection (b) as follows:20 "(b) Operation of a personal delivery device shall be limited to:21 (1) A speed of no greater than 20 miles per hour when upon a bicycle lane, shoulder, or22 roadway;23 (2) A speed of no greater than four seven miles per hour when upon a sidewalk or within24 a shared use path or safety zone; and25 (3) A speed of no less than 3.5 feet per second and no more th an four seven miles per26 hour when within a crosswalk."27 SECTION 3.28 All laws and parts of laws in conflict with this Act are repealed.29 H.
