26 LC 33 9857 House Bill 1002 By: Representatives Camp of the 135th and Hatchett of the 155th A BILL TO BE ENTITLED AN ACT To amend Article 7 of Chapter 4 of Title 49 of the Official Cod e of Georgia Annotated,1 relating to medical assistance generally, so as to transfer Med icaid coverage for foster2 children from managed care to fee-for-service; to provide for d efinitions; to provide for3 submission of state plan amendments if necessary; to provide for automatic repeal; to provide4 for related matters; to provide for an effective date; to repeal conflicting laws; and for other5 purposes.6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7 SECTION 1.8 Article 7 of Chapter 4 of Title 49 of the Official Code of Geor gia Annotated, relating to9 medical assistance generally, is amended by adding a new Code section to read as follows:10 "49-4-159.5.11 (a) As used in this Code section, the term:12 (1) 'Contract' means the agreement in effect on the effective date of this Code section13 between the department and a care management organization to pr ovide managed care14 medical assistance coverage for foster children.15 (2) 'Foster child' means an individual who:16 H. B. 1002 - 1 - 26 LC 33 9857 (A) Is less than 18 years of age and is in a foster home or otherwise in the foster care17 system under the Division of Family and Children Services of th e Department of18 Human Services; or19 (B) Is less than 26 years of age, was in a foster home or othe rwise in the foster care20 system in this state, and was receiving Medicaid coverage on hi s or her eighteenth21 birthday.22 (b) Upon expiration or renewal of the contract, or earlier if authorized under the terms of23 the contract, the department shall transfer all medical assista nce coverage for foster24 children from the care management organization to the fee-for-service Medicaid program.25 (c) The department shall submit any Medicaid state plan amendments necessary to fulfill26 the requirements of this Code section to the federal Department of Health and Human27 Services.28 (d) This Code section shall stand repealed on December 31, 2028."29 SECTION 2.30 This Act shall become effective upon its approval by the Governor or upon its becoming law31 without such approval.32 SECTION 3.33 All laws and parts of laws in conflict with this Act are repealed.34 H.
