26 LC 47 3862 House Resolution 1033 By: Representatives Draper of the 90 th, Gisler of the 121st, Willis of the 55th, Miller of the 62nd, Roberts of the 52nd, and others A RESOLUTION Proposing an amendment to the Constitution so as to provide that changes to apportionment1 and districts of the General Assembly and Congress shall only b e made in the first2 odd-numbered year subsequent to each United States decennial ce nsus; to provide that3 additional changes shall only be made when necessary to comply with a court order; to4 provide for related matters; to provide for the submission of this amendment for ratification5 or rejection; and for other purposes.6 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:7 SECTION 1.8 Article III, Section II of the Constitution is amended by revising Paragraph II as follows:9 "Paragraph II. Apportionment of General Assembly. (a) The General Assembly shall10 apportion the Senate and House districts and shall provide for Congressional districts11 pursuant to federal law. Such districts shall be composed of contiguous territory.12 (b) The apportionment and districts of the Senate, and of the House of Representatives,13 and of Congress provided for in subparagraph (a) of this paragraph shall only be changed14 by the General Assembly as necessary in the first odd-numbered year subsequent to after15 each United States decennial census.16 H. R. 1033 - 1 - 26 LC 47 3862 (c) Following the apportionment and redistricting provided for in subparagraph (b) of17 this paragraph, any additional changes shall only be made when necessary to comply with18 an order of a court of competent jurisdiction and shall be limi ted to those changes19 necessary to correct the specific deficiencies established in such court order."20 SECTION 2.21 The above proposed amendment to the Constitution shall be publi shed and submitted as22 provided in Article X, Section I, Paragraph II of the Constitution. The ballot submitting the23 above proposed amendment shall have written or printed thereon the following:24 "( ) YES25 ( ) NO 26 27 28 29 Shall the Constitution of Georgia be amended so as to provide t hat the apportionment and districts of the Senate, House of Representatives, and of Congress be changed by the General Assembly only in the first odd-numbered year subsequent to each United States decennial census unless o therwise specifically required by a court order?" All persons desiring to vote in favor of ratifying the proposed amendment shall vote "Yes."30 All persons desiring to vote against ratifying the proposed amendment shall vote "No." If31 such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall32 become a part of the Constitution of this state.33 H.
