26 LC 60 0244 House Bill 1069 By: Representatives Dunahoo of the 31st, Carpenter of the 4th, Smith of the 18th, Horner of the 3rd, Scoggins of the 14th, and others A BILL TO BE ENTITLED AN ACT To amend Chapter 10 of Title 31 of the Official Code of Georgia Annotated, relating to vital1 records, so as to require the Department of Public Health to publish and maintain statistical2 reports relating to induced terminations of pregnancy notwithstanding requirements on the3 department for physician confidentiality; to provide for except ions; to provide for related4 matters; to repeal conflicting laws; and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 Chapter 10 of Title 31 of the Official Code of Georgia Annotated, relating to vital records,8 is amended by revising Code Section 31-10-19, relating to reporting of induced termination9 of pregnancy, as follows:10 "31-10-19.11 (a) Each induced termination of pregnancy which occurs in this st ate, regardless of the12 length of gestation or weight, shall be reported directly to the department within ten days13 by the person in charge of the institution or clinic, or designated representative, in which14 the induced termination of pregnancy was performed. If the ind uced termination of15 H. B. 1069 - 1 - 26 LC 60 0244 pregnancy was performed outside an institution or clinic, the a ttending physician shall16 prepare and file the report within the time specified by this Code section.17 (b) Notwithstanding anything to the contrary in subsection (i) o f C o d e S e c t i o n18 16-12-141.1, subsection (h) of Code Section 31-9A-6, and subsection (c) of Code Section19 31-9B-3, on and after July 1, 2026, the department shall publis h on the department's20 website, either directly or via a hyperlink to a separate website or web based application,21 information containing statistics and indicators relating to in duced terminations of22 pregnancy, presented in tabular, mapped, charted, or other appr opriate form. Such23 information shall be updated and posted not less than annually and shall include, but shall24 not be limited to, data on the number of induced terminations of pregnancy beginning from25 the year 1994, which shall be broken down by year, county, age, race, and ethnicity;26 provided, however, that the posted information shall comply wit h the provisions of the27 federal Health Insurance Portability and Accountability Act of 1996, P.L. 104-191, and28 the department shall ensure none of the information posted coul d reasonably lead to the29 identification of any individual female or of any female for wh om a guardian or30 conservator has been appointed."31 SECTION 2.32 All laws and parts of laws in conflict with this Act are repealed.33 H.
