26 LC 47 3854/AP House Bill 1090 (AS PASSED HOUSE AND SENATE) By: Representative Corbett of the 174th A BILL TO BE ENTITLED AN ACT To amend an Act revising, superseding, and consolidating the laws creating and governing1 the Board of Commissioners of Echols County, approved February 3, 1953 (Ga. L. 1953,2 Jan.-Feb. Sess., p. 2054), as amended, particularly by an Act approved April 11, 2022 (Ga.3 L. 2022, p.5446), so as to provide that all of the county commissioners shall be elected from4 the county at large; to repeal the commission district plan; to provide for continuation in5 office of current members; to provide for related matters; to p rovide an effective date; to6 repeal conflicting laws; and for other purposes.7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:8 SECTION 1.9 An Act revising, superseding, and consolidating the laws creating and governing the Board10 of Commissioners of Echols County, approved February 3, 1953 (G a. L. 1953, Jan.-Feb.11 Sess., p. 2054), as amended, particularly by an Act approved April 11, 2022 (Ga. L. 2022,12 p.5446), is amended by revising Section 2 as follows:13 H. B. 1090 - 1 - 26 LC 47 3854/AP "SECTION 2.14 (a) There shall be a Board of Commissioners of Echols County, to consist of five persons15 to be elected as provided for in this Act. The board shall consist of five posts, designated16 Posts 1 through 5. In order to be elected as a member of the board from a commissioner,17 a person must have resided in the county for at least 12 months prior to election thereto and18 must receive a majority of the votes cast for such office count ywide. At the time of19 qualifying for election as a member of the board, each candidat e for such office shall20 specify the post for which that person is a candidate. A person elected as a member of the21 board from a district must continue to reside in the county dur ing the person's term of22 office or such office shall thereupon become vacant. Elections of members of the board23 shall be held in accordance with Chapter 2 of Title 21 of the O .C.G.A., the 'Georgia24 Election Code.'25 (b) Members of the board of commissioners shall serve four-year terms of office and until26 their successors are elected and qualified.27 (c)(1) The initial member of the board from Post 1 shall be th e commissioner serving28 from District 1 Post 1 on January 1, 2027.29 (2) The initial member of the board from Post 2 shall be the commissioner serving from30 District 1 Post 2 on January 1, 2027. 31 (3) The initial member of the board from Post 3 shall be the commissioner serving from32 District 2 Post 1 on January 1, 2027.33 (4) The initial member of the board from Post 4 shall be the commissioner serving from34 District 2 Post 2 on January 1, 2027.35 (5) The initial member of the board from Post 5 shall be the commissioner serving from36 District 3 on January 1, 2027."37 H. B. 1090 - 2 - 26 LC 47 3854/AP SECTION 2.38 Said Act is further amended by striking in its entirety Appendix A containing the descriptions39 of the commissioner districts which is identified as "User: Ech ols Plan Name:40 EcholsCC-2022 Plan Type: Local."41 42 SECTION 3.43 Those members of the Board of Commissioners of Echols County who are serving as such44 on the effective date of this Act and any person selected to fill a vacancy in any such office45 shall continue to serve as such members until the regular expiration of their respective terms46 of office and upon the election and qualification of their respective successors.47 SECTION 4.48 This Act shall become effective on January 1, 2027.49 SECTION 5.50 All laws and parts of laws in conflict with this Act are repealed.51 H.
