26 LC 63 0086S/AP House Bill 1086 (AS PASSED HOUSE AND SENATE) By: Representatives Chastain of the 7 th, McDonald III of the 26 th, Cannon of the 172 nd, McCollum of the 30th, Jasperse of the 11th, and others A BILL TO BE ENTITLED AN ACT To amend Chapter 2 of Title 25 of the Official Code of Georgia Annotated, relating to1 regulation of fire and other hazards to persons and property generally, so as to require notice2 to be posted upon certain buildings of the use of light-frame t russ-type construction and3 engineered I-joists (EIJ); to provide for rules and regulations; to provide for enforcement; to4 provide for definitions; to provide for a short title; to provide for related matters; to repeal5 conflicting laws; and for other purposes.6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7 SECTION 1.8 This Act shall be known and may be cited as the "Preston Fant and Brant Chesney Firefighter9 Safety Act."10 SECTION 2.11 Chapter 2 of Title 25 of the Official Code of Georgia Annotated, relating to regulation of fire12 and other hazards to persons and property generally, is amended by adding a new Code13 section to read as follows:14 H. B. 1086 - 1 - 26 LC 63 0086S/AP "25-2-13.1.15 (a) As used in this Code section, the term:16 (1) 'Engineered I-joists' means structural elements consisting of a thin web of material17 sandwiched between two flanges, forming an 'I' shape.18 (2) 'Light-frame truss-type construction' means a type of cons truction for which the19 primary structural elements are formed by a system of repetitive wood or light gauge steel20 framing members.21 (b) The owner of any commercial or industrial building or stru cture, or any multiunit22 residential building or structu re of three units or more, that uses light-frame truss-type23 construction or engineered I-joists (EIJ) shall post notice upon such building or structure24 with a sign or symbol approved by the Commissioner in a manner sufficient to warn25 persons conducting fire fighting or other emergency services of the existence of light-frame26 truss-type construction or engineered I-joists (EIJ).27 (c) The Commissioner shall adopt rules and regulations necessa ry to implement the28 provisions of this Code section, including, but not limited to:29 (1) The dimensions and color of the sign or symbol required to be posted;30 (2) The time within which an owner of commercial, industrial, and multiunit residential31 buildings or structures that use light-frame truss-type construction or engineered I-joists32 (EIJ) shall be required to comply with this Code section; and33 (3) The location at each co mmercial, industrial, and multiunit residential building or34 structure that uses light-frame truss-type construction or engineered I-joists (EIJ) where35 such sign or symbol shall be posted.36 (d) The Commissioner, state fire marshal, and local fire marsh als shall be authorized to37 enforce the provisions of this Code section. Any owner who fai ls to comply with38 subsection (b) of this Code section shall be subject to civil penalties under Code Section39 25-2-37."40 H.
