HB1160: HB1160 Civil practice; tolling of limitations; provide for surviving relatives in wrongful death actions

26 LC 49 2692S The House Committee on Judiciary offers the following substitute to HB 1160: A BILL TO BE ENTITLED AN ACT To amend Article 5 of Chapter 3 of Title 9 of the Official Code of Georgia Annotated,1 relating to tolling of limitations, so as to provide for the to lling of limitations for certain2 wrongful death actions; to provide for related matters; to repe al conflicting laws; and for3 other purposes.4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:5 SECTION 1.6 Article 5 of Chapter 3 of Title 9 of the Official Code of Georgia Annotated, relating to tolling7 of limitations, is amended by revising Code Section 9-3-99, relating to tolling of limitations8 for tort actions while criminal prosecution is pending, as follows:9 "9-3-99.10 The running of the period of limitations with respect to any cause of action in tort that may11 be brought by the victim of an alleged crime or that may be brought under subsection (c)12 of Code Section 19-7-1 or Code Section 51-4-2 or 51-4-4 for the wrongful death of the13 victim of an alleged crime which arises out of the facts and circumstances relating to the14 commission of such alleged crime committed in this state shall be tolled from the date of15 the commission of the alleged crime or the act giving rise to s uch action in tort until the16 H. B. 1160 (SUB) - 1 - 26 LC 49 2692S prosecution of such crime or act has become final or otherwise terminated, provided that17 such time does not exceed six years, except as otherwise provid ed in Code Section18 9-3-33.1."19 SECTION 2.20 All laws and parts of laws in conflict with this Act are repealed.21 H.
