A BILL TO BE ENTITLED
AN ACT
To amend Chapter 12 of Title 50 of the Official Code of Georgia Annotated, relating to1
commissions and other agencies, so as to provide for the establ ishment of the Georgia2
Artificial Intelligence Commission; to provide for responsibilities; to provide for purpose;3
to provide for assignment to the Georgia Technology Authority; to provide for annual4
reports; to provide for membership, terms, meetings, and compen sation; to provide for5
definitions; to provide for related matters; to repeal conflicting laws; and for other purposes.6
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7
SECTION 1.8
Chapter 12 of Title 50 of the Official Code of Georgia Annotated, relating to commissions9
and other agencies, is amended by adding a new article to read as follows:10
"ARTICLE 911

(a) As used in this Code section, the term:13

(1) 'Artificial intelligence system' or 'AI system' means an engineered or machine based14
system that emulates the capability of a person to receive audio, visual, text, or any other15
form of information and use the information received to emulate a human cognitive16
process, including, but not limited to, learning, generalizing, reasoning, planning,17
predicting, acting, or communicating; provided, however, that a rtificial intelligence18
systems may vary in the forms of information they can receive a nd in the human19
cognitive processes they can emulate.20
(2) 'Commission' means the Georgia Artificial Intelligence Commission.21
(b) There is created the Georgia Artificial Intelligence Commi ssion, responsibilities of22
which shall include:23
(1) Making recommendations to the General Assembly and to the chief information24
officer of the State of Georgia on legislative and executive actions regarding AI systems;25
(2) Developing and recommending state-wide processes, principles, and guidelines for26
executive, legislative, and judicial agencies to follow regarding the use of AI systems;27
(3) Encouraging state agencies to utilize AI systems to improv e services when28
appropriate;29
(4) Examining, developing, and recommending actions that ensure AI systems are used30
in a safe and secure manner;31
(5) Conducting an inventory of all AI systems used in state agencies; and 32
(6) Identifying high risk areas for the implementation of artificial intelligence.33
(c) The commission shall be assigned to the Georgia Technology Authority for34
administrative purposes only, as prescribed in Code Section 50-4-3.35
(d) The commission shall consist of 16 members to be appointed by the Governor by36
January 1, 2027, as follows:37
(1) The chief information office of the State of Georgia, or his or her designee;38
(2) The Attorney General, or his or her designee;39
(3) The Commissioner of Labor, or his or her designee;40

(4) The State School Superintendent, or his or her designee;41
(5) The Secretary of State, or his or her designee;42
(6) The commissioner of public health, or his or her designee;43
(7) The commissioner of public safety, or his or her designee;44
(8) The Commissioner of Agriculture;45
(9) A member of the Senate majority party;46
(10) A member of the Senate minority party;47
(11) A member of the House of Representatives majority party;48
(12) A member of the House of Representatives minority party;49
(13) Two members of institutions of higher education that specialize in AI systems; and50
(14) Two members representing priv ate companies with expertise in developing AI51
systems.52
(e) Each member of the commission shall serve a three-year ter m and until the53
appointment and qualification of such member's successor. Any member with four54
consecutive unexcused absences from regular monthly meetings of the commission may55
be removed from the commission by the Governor. A majority of the commission shall56
constitute a quorum, and the concurrence of a majority shall be required for the57
determination of any matter within its duties.58
(f) Commission members shall receive no compensation for their services but shall be59
allowed actual and necessary expenses in the performance of their duties. The legislative60
members of the committee shall receive the allowances provided for in Code61
Section 28-1-8. Citizen members shall receive a daily expense allowance in the amount62
specified in subsection (b) of Code Section 45-7-21, as well as the mileage or63
transportation allowance authorized for state employees. Members appointed to serve on64
the commission who are state officials or state employees shall receive no compensation65
for their services on the commission but shall be reimbursed for expenses incurred in the66
performance of their duties as members of the commission in the same manner as67

reimbursements are made in their capacity as state officials or state employees. The funds68
necessary for the reimbursement of the expenses of state officials and state employees shall69
come from funds appropriated to or otherwise available to their respective departments.70
(g) The commission shall elect a chairperson and vice chairperson from among its number71
at its first meeting and such individuals shall serve until the ir successors are elected and72
qualified. In the event that the position of chairperson becom es vacant, the vice73
chairperson shall fulfill the duties of the chairperson.74
(h) The chairperson of the commission shall have the following duties:75
(1) Set a date, time, and place for the regular monthly meetings of the commission; and76
(2) Supervise the preparation and distribution of meeting notices, agendas, minutes, and77
other documents prepared by or on behalf of the commission.78
(i) The commission may adopt rules necessary for its operation.79
(j) The commission, no later than December 31, 2027, and annually thereafter shall submit80
to the Governor, President of the Senate, and the Speaker of the House of Representatives81
an annual report of the commission's activities for the previou s year and goals for the82
upcoming year. Such report may also include proposals for legi slation, administrative83
action, or other policy changes the commission considers necessary to further the goals and84
purposes of the commission.85
(k) The commission shall begin operations no later than January 1, 2027."86
SECTION 2.87
All laws and parts of laws in conflict with this Act are repealed.88
