26 LC 62 0329 Senate Bill 464 By: Senators Howard of the 35th, Kemp of the 38th, Mangham of the 55th, Rhett of the 33rd, Merritt of the 9th and others A BILL TO BE ENTITLED AN ACT To amend Chapter 1 of Title 35 of the Official Code of Georgia Annotated, relating to1 general provisions regarding law enforcement officers and agencies, so as to prohibit federal2 immigration authorities from utilizing certain technologies to identify individuals for certain3 purposes; to provide for definitions; to provide for related matters; to repeal conflicting laws;4 and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 Chapter 1 of Title 35 of the Official Code of Georgia Annotated , relating to general8 provisions regarding law enforcement officers and agencies, is amended by adding a new9 Code section to read as follows:10 "35-1-25.11 (a) As used in this Code section, the term:12 (1) 'Biometric data' means any unique physical representation, including, but not limited13 to, fingerprints, voice prints, retina or iris images, or DNA profiles.14 (2) 'Biometric surveillance technology' means a technology used for the identification15 of an individual through the use of his or her biometric data.16 S. B. 464 - 1 - 26 LC 62 0329 (b) Federal immigration authorities shall not use biometric su rveillance technology to17 identify individuals for the purpose of verifying immigration status."18 SECTION 2.19 All laws and parts of laws in conflict with this Act are repealed.20 S. B. 464 - 2 -
