26 LC 56 0547/AP House Resolution 1243 (AS PASSED HOUSE AND SENATE) By: Representatives Martin of the 49th, Burns of the 159th, Hugley of the 141st, Crowe of the 118th, Camp of the 135th, and others A RESOLUTION Proposing an amendment to the Constitution so as to authorize creation of the Georgia Next1 Generation 9-1-1 Fund; to provide for submission of this amendm ent for ratification or2 rejection; and for other purposes.3 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:4 SECTION 1.5 Article III, Section IX of the Constitution is amended in Parag raph VI by adding a new6 subparagraph to read as follows:7 "(s) The General Assembly is authorized to provide by general law for the creation of the 8 Georgia Next Generation 9-1-1 Fund. The General Assembly may provide by general law9 for the dedication and deposit of revenues raised from specified sources for the purposes10 of the fund into the fund. Moneys in the fund shall be exclusively used for the expansion,11 maintenance, and operation of 9-1-1 systems throughout the state, including the transition12 to Next Generation 9-1-1, as such term may be defined by the General Assembly, and all13 expenses related thereto. Any other appropriation from the Georgia Next Generation 9-1-114 Fund shall be void. Contributions and revenues deposited to the fund shall not lapse and15 shall not be subject to the limitations of subparagraph (a) of this Paragraph or of16 Article VII, Section III, Paragraph II."17 H. R. 1243 - 1 - 26 LC 56 0547/AP SECTION 2.18 The above proposed amendment to the Constitution shall be publi shed and submitted as19 provided in Article X, Section I, Paragraph II of the Constitution. The ballot submitting the20 above proposed amendment shall have written or printed thereon the following:21 "( ) YES22 ( ) NO 23 24 25 26 Shall the Constitution of Georgia be amended so as to authorize the General Assembly to dedicate certain existing revenues, including reven ues reallocated by law, to a nonlapsing fund to be used exclusively f o r t h e expansion, maintenance, and operation of emergency 9-1-1 system s in this state?" All persons desiring to vote in favor of ratifying the proposed amendment shall vote "Yes." 27 All persons desiring to vote against ratifying the proposed amendment shall vote "No." If28 such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall29 become a part of the Constitution of this state.30 H.
