26 LC 52 0946 Senate Bill 481 By: Senators Parent of the 44th, Jones II of the 22nd, Mangham of the 55th, Jackson of the 41st, Harrell of the 40th and others A BILL TO BE ENTITLED AN ACT To amend Article 7 of Chapter 4 of Title 49 of the Official Cod e of Georgia Annotated,1 relating to medical assistance generally, so as to require Medi caid coverage for heart and2 lung transplants when medically necessary; to provide for relat ed healthcare services3 including immunosuppressant drugs; to provide for a state plan amendment or waiver4 request; to provide for related matters; to repeal conflicting laws; and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 Article 7 of Chapter 4 of Title 49 of the Official Code of Geor gia Annotated, relating to8 medical assistance generally, is amended by adding a new Code section to read as follows:9 "49-4-159.5.10 (a) The department shall provide Medicaid coverage for heart and lung transplants when11 such procedures are determined by a duly licensed physician in this state to be medically12 necessary. Such coverage shall include related healthcare services before and after such13 transplants and immunosuppressant drugs.14 S. B. 481 - 1 - 26 LC 52 0946 (b) The department shall submit any Medicaid state plan amendment or waiver requests15 necessary to implement the provisions of this Code section to the United States Department16 of Health and Human Services."17 SECTION 2.18 All laws and parts of laws in conflict with this Act are repealed.19 S.
