26 LC 47 3769/AP House Bill 1258 (AS PASSED HOUSE AND SENATE) By: Representatives Reese of the 140th, Hugley of the 141st, Rice of the 139th, Buckner of the 137th, and Smith of the 138th A BILL TO BE ENTITLED AN ACT To amend an Act establishing the State Court of Muscogee County, approved December 20,1 1884 (Ga. L. 1884-85, p. 455), as amended, particularly by an Act approved March 19, 19872 (Ga. L. 1987, p. 4423), so as to provide an additional judge; to provide for the election of the3 initial additional judge; to provide for terms of office of said additional judge and successors4 to such judge; to provide for the powers and privileges of said additional judge; to provide5 for the compensation and expenses of said additional judge; to provide for related matters;6 to repeal conflicting laws; and for other purposes.7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:8 SECTION 1.9 An Act establishing the State Court of Muscogee County, approved December 20, 1884 (Ga.10 L. 1884-85, p. 455), as amended, particularly by an Act approve d March 19, 1987 (Ga. L.11 1987, p. 4423), is amended by revising subsection (a) of Section 2.1 as follows:12 "(a) As of January 1, 2027, the S tate Court of Muscogee County shall consist of three13 judges. The two judges of the state court in office on December 31, 2026, shall serve out14 the terms of office to which such judges were elected or appointed. The third judge of the15 state court shall be elected in a manner provided by law for th e election of judges of the16 H. B. 1258 - 1 - 26 LC 47 3769/AP state courts of this state at the nonpartisan general election in 2026, for a term of four years17 beginning on January 1, 2027, and until his or her successor is elected and qualified. Such18 election shall be held and conducted in a manner provided for b y law for the election of19 judges of the state courts of this state. Each judge shall have and may exercise all powers,20 duties, dignity, jurisdiction, privileges, and immunities of the present judges of the State21 Court of Muscogee County. The compensation, salary, supplement s, and contingent22 expense allowances of the third judge shall be the same as that of the other judges of the23 State Court of Muscogee County."24 SECTION 2.25 All laws and parts of laws in conflict with this Act are repealed.26 H.
