26 LC 47 3833/AP House Bill 1245 (AS PASSED HOUSE AND SENATE) By: Representatives Cameron of the 1st and Tarvin of the 2nd A BILL TO BE ENTITLED AN ACT To amend an Act providing for the election of the members of th e Board of Education of1 Walker County, approved March 8, 1968 (Ga. L. 1968, p. 2235), a s amended, so as to2 provide that future members of the board shall be elected by th e voters of the respective3 education districts instead of by voters of the entire school s ystem; to provide for related4 matters; to repeal conflicting laws; and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 An Act providing for the election of the members of the Board o f Education of Walker8 County, approved March 8, 1968 (Ga. L. 1968, p. 2235), as amended, is amended by revising9 subsection (a) of Section 1 as follows:10 "(a) For the purpose of electing members of the board of educat ion, the Walker County11 School District shall be divided into five education districts. One member of the board,12 which shall consist of five members, shall be elected from each of the education districts,13 and each member shall be a resident of the district from which he or she is elected and shall14 be elected only by the qualified voters of such education district. Districts 1, 2, 3, 4, and 515 shall be and correspond to those five numbered districts described in Appendix A attached16 H. B. 1245 - 1 - 26 LC 47 3833/AP to and made a part of this Act and further identified as 'User: HD002 Plan Name:17 WalkerSB-2022 Plan Type: Local'."18 SECTION 2.19 Said Act is further amended by revising Section 5 as follows:20 "SECTION 5. 21 Vacancies on the board which occur within the first two years of a term of office shall be22 filled by the remaining members of the board electing a successor, who shall be a resident23 of the election district from which the vacancy occurs, to serv e until the next general24 education, at which time a successor shall be elected by the qu alified voters of such25 education district to serve the unexpired term. Vacancies occu rring during the last two26 years of a term of office shall be filled by the remaining members of the board electing a27 successor, who shall be a resident of the education district in which the vacancy occurred,28 to serve out the unexpired term of office. The Walker County Board of Education created29 by this Act shall be the successor to all the rights, powers, d uties and obligations of the30 previous Walker County Board of Education and shall be subject to all constitutional and31 statutory provisions relating to county boards of education except as otherwise provided32 in this Act."33 SECTION 3.34 All laws and parts of laws in conflict with this Act are repealed.35 H.
