26 LC 52 1018/AP House Bill 1278 (AS PASSED HOUSE AND SENATE) By: Representatives Hawkins of the 27th, Stephens of the 164th, Greene of the 154th, Newton of the 127th, Schofield of the 63rd, and others A BILL TO BE ENTITLED AN ACT To amend Article 1 of Chapter 11 of Title 43 of the Official Co de of Georgia Annotated,1 relating to general provisions relative to dentists, dental hygienists, and dental assistants, so2 as to improve efficiencies in the issuance of permits for denti sts to administer conscious3 sedation and general anesthesia; to provide for the evaluation and certification of a properly4 equipped facility; to provide for demonstration of proficiency in administering sedative5 techniques; to authorize the board to designate qualified perso nnel to perform certain6 evaluations, certifications, and examinations; to provide for r elated matters; to repeal7 conflicting laws; and for other purposes.8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:9 SECTION 1.10 Article 1 of Chapter 11 of Title 43 of the Official Code of Geo rgia Annotated, relating to11 general provisions relative to dentists, dental hygienists, and dental assistants, is amended12 in Code Section 43-11-21, relating to conscious sedation, by revising subsections (b) and (c)13 as follows:14 "(b) No dentist shall be issued a permit under this Code sectio n unless the board has15 received satisfactory evidence that such dentist:16 H. B. 1278 - 1 - 26 LC 52 1018/AP (1) Has received formal training in the use of conscious sedat ion at an institution17 accredited by the Commission on Dental Accreditation of the Ame rican Dental18 Association (ADA), its successor agency, or other board approved organization an d is19 certified by such organization as competent in the administration of pharmacologic agents20 for conscious sedation and the handling of emergencies relating to conscious sedation. 21 Such certification shall specify the type, number of hours, and length of training. The22 minimum didactic hours, patient contact hours, and number of pa tients sedated under23 supervision shall be established by rule or regulation of the board;24 (2) Utilizes a properly equipped facility for the administrati on of conscious sedation,25 including physical plant and equipment, which has been evaluate d and certified by an26 on-site examination the board or any designee thereof; and27 (3) Has demonstrated to the satisfaction of the board or any designee thereof proficiency28 in administering sedative techniques in the dentist's office on a patient or patients in a29 safe and effective manner.30 (c) In enforcing the provisions of this Code section, the board is authorized to designate31 qualified persons to perform the on-site any evaluations, certifications, and examinations32 required or authorized by this Code section and is further authorized to provide by rule or33 regulation for standards for physical plant, equipment, and personnel to be utilized in the34 induction of conscious sedation."35 SECTION 2.36 Said article is further amended in Code Section 43-11-21.1, relating to general anesthesia,37 by revising subsections (b) and (c) as follows:38 "(b) No dentist shall be issued a permit under this Code sectio n nor have such permit39 renewed unless the board has received satisfactory evidence that such dentist:40 (1)(A) Has successfully completed a minimum of one year of adv anced training in41 anesthesiology and related academic subjects beyond the undergraduate dental school42 H. B. 1278 - 2 - 26 LC 52 1018/AP level at an institution accredited by the Commission on Dental Accreditation of the43 American Dental Association or its successor agency or by a nat ionally recognized44 health care accreditation body for hospitals; or45 (B) Is a diplomate of the American Board of Oral and Maxillofa cial Surgery, is a46 member of the American Association of Oral and Maxillofacial Surgeons, or is a fellow47 of the American Dental Society of Anesthesiology;48 (2) Utilizes a properly equipped facility for the administrati on of general anesthesia,49 including physical plant and equipment which has been evaluated and certified by an50 on-site examination the board or any designee thereof; and51 (3) Has demonstrated to the satisfaction of the board or any designee thereof proficiency52 in administering general anesthesia on a patient or patients in the dentist's office in a safe53 and effective manner.54 (c) In enforcing the provisions of this Code section, the board is authorized to designate55 qualified persons to perform the on-site any evaluations, certifications, and examinations56 required or authorized by this Code section and is further authorized to provide by rule or57 regulation for standards for physical plant, equipment, and personnel to be utilized in the58 administration of general anesthesia."59 SECTION 3.60 All laws and parts of laws in conflict with this Act are repealed.61 H.
