26 LC 49 2665 House Bill 1322 By: Representatives Cheokas of the 151st, Crowe of the 118th, Lumsden of the 12th, DeLoach of the 167th, Cannon of the 172nd, and others A BILL TO BE ENTITLED AN ACT To amend Code Section 16-11-30 of the Official Code of Georgia Annotated, relating to riot,1 so as to repeal the misdemeanor penalty and provide for a felon y penalty; to amend Code2 Section 17-6-1 of the Official Code of Georgia Annotated, relating to when offenses bailable,3 procedure, schedule of bails, and appeal bonds, so as to include the offense of riot; to provide4 for related matters; to repeal conflicting laws; and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 Code Section 16-11-30 of the Official Code of Georgia Annotated , relating to riot, is8 amended as follows:9 "16-11-30.10 (a) Any two or more persons who shall do an unlawful act of violence or any other act in11 a violent and tumultuous manner commit the offense of riot.12 (b) Any persons who violate subsection (a) of this Code sectio n are shall be guilty of a13 misdemeanor felony and, upon conviction thereof, shall be punished by imprisonment for14 not less than one nor more than 20 years."15 H. B. 1322 - 1 - 26 LC 49 2665 SECTION 2.16 Code Section 17-6-1 of the Official Code of Georgia Annotated, relating to when offenses17 bailable, procedure, schedule of bails, and appeal bonds, is amended by revising paragraphs18 (13) and (14) of subsection (a) and adding a new paragraph to read as follows:19 "(13) Violating Code Section 16-5-46; and20 (14) Violations of Chapter 15 of Title 16; and21 (15) Riot."22 SECTION 3.23 All laws and parts of laws in conflict with this Act are repealed.24 H.
