26 LC 62 0402 Senate Bill 529 By: Senators Merritt of the 9th, Jones II of the 22nd, Parent of the 44th, Halpern of the 39th, Anderson of the 43rd and others A BILL TO BE ENTITLED AN ACT To amend Article 5 of Chapter 3 of Title 51 of the Official Cod e of Georgia Annotated,1 relating to negligent security, so as to exempt certain victims from using an exclusive2 remedy; to provide for a conforming change; to provide for a short title; to provide for related3 matters; to repeal conflicting laws; and for other purposes.4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:5 SECTION 1.6 This Act shall be known and may be cited as the "Justice For Epstein Survivors Act."7 SECTION 2.8 Article 5 of Chapter 3 of Title 51 of the Official Code of Geor gia Annotated, relating to9 negligent security, is amended by revising subsection (a) of and adding a new subsection to10 Code Section 51-3-53, relating to limitations on liability, to read as follows:11 "(a) Except as otherwise provided in subsections (b), and (c), and (d) of this Code section,12 the provisions of this article shall be the sole and exclusive remedy for negligent security13 against owners or occupiers, and no owner or occupier shall be liable for negligent security14 except as provided in this article."15 S. B. 529 - 1 - 26 LC 62 0402 "(d) Nothing in this article shall be construed to limit or oth erwise affect any claim,16 remedy, or cause of action where the wrongful conduct is relate d to a violation of any17 sexual offenses set forth in Chapter 6 of Title 16 or any claim, remedy, or cause of action18 where the wrongful conduct injures a person who, at the time of the injury, was younger19 than 18 years of age or 65 years of age or older."20 SECTION 2.21 All laws and parts of laws in conflict with this Act are repealed.22 S.
