26 LC 61 0401 House Bill 1418 By: Representatives Adeyina of the 110th, Jones of the 25th, Schofield of the 63rd, Beckles of the 96th, Davis of the 87th, and others A BILL TO BE ENTITLED AN ACT To amend Chapter 60 of Title 36 of the Official Code of Georgia Annotated, relating to1 general provisions applicable to counties and municipal corporations, so as to authorize local2 governments to establish resource recovery programs in order to reduce hunger and food3 waste and to utilize a digital platform for such programs; to provide requirements for digital4 platforms; to limit liability of participants in certain circumstances; to provide definitions;5 to provide for related matters; to provide a short title; to repeal conflicting laws; and for other6 purposes.7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:8 SECTION 1.9 This Act shall be known and may be cited as the "Georgia Resource Exchange and Sharing10 for Community Uplift and Emergency Resilience (RESCUER) Act."11 SECTION 2.12 Chapter 60 of Title 36 of the Official Code of Georgia Annotate d, relating to general13 provisions applicable to counties and municipal corporations, is amended by adding a new14 Code section to read as follows:15 H. B. 1418 - 1 - 26 LC 61 0401 "36-60-34.16 (a) As used in this Code section, the term:17 (1) 'Local community' means:18 (A) Individuals residing within the boundaries of a county or municipal corporation;19 and20 (B) Food banks, restaurants, grocery stores, and other retailers that offer food in such21 county or municipal corporation.22 (2) 'Resource recovery program' or 'program' means a voluntary program that connects23 members of a local community to allow such members to share foo d with the goal of24 reducing hunger and food waste.25 (b) The governing authority of each county and the governing authority of each municipal26 corporation shall be authorized to establish a resource recover y program for the local27 community of such county or municipal corporation and utilize a digital platform for such28 program. A digital platform used for a resource recovery progra m shall allow such29 governing authority to limit participation in the program to me mbers of the local30 community.31 (c) A member of the local community who in good faith shares food through a resource32 recovery program and a digital platform used for a resource recovery program shall not be33 subject to criminal penalty or civil damages arising from the condition of the food, unless34 injury is caused by the recklessness or intentional misconduct of such member of the local35 community."36 SECTION 3.37 All laws and parts of laws in conflict with this Act are repealed.38 H.
