SB547: SB547 Offenses of Pimping and Pandering; modify the penalties

26 LC 49 2697 Senate Bill 547 By: Senators Strickland of the 42nd, Robertson of the 29th, Hatchett of the 50th, Bearden of the 30th, Williams of the 25th and others AS PASSED A BILL TO BE ENTITLED AN ACT To amend Code Section 16-6-13 of the Official Code of Georgia A nnotated, relating to1 penalties for violating Code Sections 16-6-9 through 16-6-12, so as to modify the penalties2 for the offenses of pimping and pandering; to provide that all such offenses shall be3 punishable as felony offenses; to provide for related matters; to provide an effective date and4 for applicability; to repeal conflicting laws; and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 Code Section 16-6-13 of the Official Code of Georgia Annotated, relating to penalties for8 violating Code Sections 16-6-9 through 16-6-12, is amended by r evising subsection (a) as9 follows:10 "(a) Except as otherwise provided in subsection (b) of this Cod e section, a A person11 convicted of violating:12 (1) Code Section 16-6-10 shall be punished as for a misdemeano r of a high and13 aggravated nature, and at the sole discretion of the judge, all but 24 hours of any term of14 imprisonment imposed may be suspended, stayed, or probated;15 (2) Code Section 16-6-9 shall be punished as for a misdemeanor;16 S. B. 547 - 1 - 26 LC 49 2697 (3) Code Section 16-6-11 for a:17 (A) First offense shall be punished as for a misdemeanor of a high and aggravated18 nature, and at the sole discretion of the judge, all but 72 hou rs of any term of19 imprisonment imposed may be suspended, stayed, or probated; and20 (B) Second or subsequent offense shall be guilty of a felony and shall be punished by21 a term of imprisonment of not less than one year nor more than ten years; or22 (4) Code Section 16-6-12 for a:23 (A) First offense shall be punished as for a misdemeanor of a high and aggravated24 nature, and at the sole discretion of the judge, all but 72 hou rs of any term of25 imprisonment imposed may be suspended, stayed, or probated; and26 (B) Second or subsequent offense shall be guilty of a felony and shall be punished by27 a term of imprisonment of not less than one year nor more than ten years."28 SECTION 2.29 This Act shall become effective on July 1, 2026, and shall apply to all offenses committed30 on or after such date.31 SECTION 3.32 All laws and parts of laws in conflict with this Act are repealed.33 S.
