A BILL TO BE ENTITLED
AN ACT
To amend Chapter 1 of Title 35 of the Official Code of Georgia Annotated, relating to1
general provisions regarding law enforcement officers and agencies, so as to prohibit covered2
governmental entities from providing funding or resources in su pport of the operation of3
immigration detention centers; to provide for definitions; to provide for related matters; to4
repeal conflicting laws; and for other purposes.5
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6
SECTION 1.7
Chapter 1 of Title 35 of the Official Code of Georgia Annotated , relating to general8
provisions regarding law enforcement officers and agencies, is amended by adding a new9
Code section to read as follows:10
"35-1-17.1.11
(a) As used in this Code section, the term:12
(1) 'Covered entity' means every:13
(A) State department, agency, board, bureau, office, commission, public corporation,14
authority, and political subdivision thereof;15
(B) County, municipal corporation, local school district, and political subdivision16
thereof of the State of Georgia; and17

(C) City, county, regional, and other authority established pursuant to the laws of the18
State of Georgia.19
(2) 'Detainee' means a noncitizen who is held in an immigration detention center pending20
immigration proceedings or removal from the United States under the authority of the21
United States Department of Homeland Security or United States Immigration and22
Customs Enforcement.23
(3) 'Immigration detention center' means any facility located in this state that holds24
detainees, including private facilities contracted by the federal government to hold such25
detainees.26
(b) No covered entity shall provide funding or resources in su pport of the operation of27
immigration detention centers."28
SECTION 2.29
All laws and parts of laws in conflict with this Act are repealed.30
