HB1429: HB1429 Courts; juvenile court clerks collect and submit data regarding monetary sanctions assessed for juvenile offenders to the Administrative Office of the Courts; require

29 LC 48 1810S The House Committee on Judiciary, Juvenile offers the following substitute to HB 1429: A BILL TO BE ENTITLED AN ACT To amend Code Section 15-11-64 of the Official Code of Georgia Annotated, relating to1 collection of information by juvenile court clerks, reporting requirement, and data collection,2 so as to require that juvenile court clerks collect and submit data regarding monetary3 sanctions assessed for juvenile offenders to the Administrative Office of the Courts; to4 provide for reporting requirements; to provide for related matters; to repeal conflicting laws;5 and for other purposes.6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7 SECTION 1.8 Code Section 15-11-64 of the Official Code of Georgia Annotated, relating to collection of9 information by juvenile court clerks, reporting requirement, and data collection, is amended10 by adding new subsections to read as follows:11 "(e) Each clerk of the juvenile court shall collect the following information for each child12 in need of services, delinquent child, and child accused of a misdemeanor or felony offense13 and shall provide to the Administrative Office of the Courts in a form and format specified14 by the Administrative Office of the Courts and incorporated into the Georgia Juvenile Data15 - 1 - 29 LC 48 1810S Exchange or any such successor database maintained by the Administrative Office of the16 Courts such information:17 (1) Sex;18 (2) Age;19 (3) Race;20 (4) Offense charged;21 (5) Location of the offense, including whether the offense occ urred in a school safety22 zone, as such term is defined in Code Section 16-11-127.1;23 (6) The name of the referral source, including the name of the school district if the24 referring source was a school;25 (7) Disposition of the case, including any monetary sanctions which may include, but are26 not limited to, fines, fees, court costs, and restitution;27 (8) Sentence imposed, including the type and amount of monetar y sanctions such as28 fines, court costs, and restitution;29 (9) Court of jurisdiction; and30 (10) The collection status of any monetary sanctions.31 (f) All such data elements shall be submitted through a regular scheduled data upload into32 the Georgia Juvenile Data Exchange at the maximum frequency all owed by local case33 management system parameters; provided, however, that such upload shall occur no less34 than once per week. The Administrative Office of the Courts sh all compile all data35 collected pursuant to subsection (e) of this Code section by April 15, 2027, and annually36 thereafter. The compiled data report shall be made publicly available and incorporated into37 the Georgia Juvenile Data Exchange."38 SECTION 2.39 All laws and parts of laws in conflict with this Act are repealed.40 - 2 -
