HB1459: HB1459 Local government; allow governing authority of any county or municipal corporation to hold meetings by teleconference

Georgia's open meetings law (O.C.G.A. § 50-14-1) already lets certain bodies, such as development authorities, hospital authorities, and library boards, meet by teleconference under specific conditions. County commissions and city councils have not been on that list for their regular business. This bill adds them. Under the bill, the governing authority of any county or municipal corporation could hold meetings by teleconference if the meeting offers the public a way to view it and to comment without being physically present. This teleconference option would apply specifically to meetings held mainly to consider zoning matters that require public hearings, and to meetings of a committee of the whole or other committee where no official action is taken. The bill also adds a new category: governing bodies made up entirely of nonelected members would be allowed to meet by teleconference as well, without those same restrictions.

• Adds the governing authority of any Georgia county or municipal corporation to the list of bodies that may hold teleconference meetings under O.C.G.A. § 50-14-1.
• Limits this new teleconference option for counties and cities to zoning related public hearings and to committee-of-the-whole or other committee meetings where no official action is taken.
• Requires that any such teleconference meeting provide a way for the public to view it and to comment without attending in person.
• Adds a new category allowing any governing body composed entirely of nonelected members to hold meetings by teleconference.
• Repeals any existing state laws that conflict with these changes.

County commissions, city councils, and their staff who organize public meetings; residents who attend or want to comment on local zoning decisions and committee meetings; and nonelected boards or agencies that oversee local or state functions.

If enacted, local elected officials could participate in certain meetings remotely rather than gathering in person, provided the public still has a way to watch and speak up. This could change how residents access zoning hearings and some committee sessions, and how nonelected boards conduct routine business.

• Section 1 revises subsection (h) of O.C.G.A. § 50-14-1 to add a new subparagraph (G) allowing county and municipal governing authorities to meet by teleconference.
• This teleconference allowance for counties and municipalities applies only to (i) meetings primarily for zoning matters requiring public hearings, or (ii) committee-of-the-whole or other committee meetings where no official action is taken.
• Any such meeting must offer one or more methods for the public to view the meeting and provide commentary without being physically present.
• A new subparagraph (H) allows any governing body whose membership is composed wholly of nonelected members to hold meetings by teleconference.
• Section 2 repeals any conflicting state laws.
