26 LC 47 4100 Senate Bill 578 By: Senators Jones of the 10th and Anderson of the 43rd A BILL TO BE ENTITLED AN ACT To amend an Act establishing in DeKalb County districts from which members of the county1 board of education shall be elected, approved April 12, 1963 (G a. L. 1963, p. 3424), as2 amended, so as to change the description of the education districts; to provide for the election3 at large of the chairperson of such board of education; to prov ide for definitions and4 inclusions; to provide for continuation in office of current me mbers; to provide for a5 referendum, effective dates, automatic repeal, mandatory execution of election, and judicial6 remedies regarding failure to comply; to provide for related ma tters; to repeal conflicting7 laws; and for other purposes.8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:9 SECTION 1.10 An Act establishing in DeKalb County districts from which members of the county board of11 education shall be elected, approved April 12, 1963 (Ga. L. 1963, p. 3424), as amended, is12 amended by revising Section 1 as follows:13 S. B. 578 - 1 - 26 LC 47 4100 "SECTION 1.14 (a) There is created the board of education of DeKalb County. The board of education15 shall consist of seven members elected as provided in subsection (b) of this section.16 (b) For purposes of electing members of the board of education , the DeKalb County17 School District is divided into seven education districts. One member of the board shall18 be elected from each such district. Education districts 1, 2, 3, 4, 5, and 6 shall be and19 correspond to those six numbered districts described in Appendi x A and attached to and20 made a part of this Act and further identified as 'User: SD10 Plan Name: 21 DekSB-SD10-p1-2026 Plan Type: Local'. Education district 7 shall be composed of the22 entire geographic area of the DeKalb County School District and the person elected from23 such district shall serve as the chairperson of the board of education.24 (c) For the purposes of such plan:25 (1) The term 'VTD' shall mean and describe the same geographic al boundaries as26 provided in the report of the Bureau of the Census for the United States decennial census27 of 2020 for the State of Georgia. The separate numeric designa tions in a district28 description which are underneath a 'VTD' heading shall mean and describe individual29 Blocks within a VTD as provided in the report of the Bureau of the Census for the United30 States decennial census of 2020 for the State of Georgia; and31 (2) Except as otherwise provided in the description of any dis trict, whenever the32 description of any district refers to a named city, it shall me an the geographical33 boundaries of that city as shown on the census maps for the Uni ted States decennial34 census of 2020 for the State of Georgia.35 (d) Any part of the DeKalb County School District which is not included in any district36 described in subsection (b) of this section shall be included within that district contiguous37 to such part which contains the least population according to the United States decennial38 census of 2020 for the State of Georgia.39 S. B. 578 - 2 - 26 LC 47 4100 (e) Any part of DeKalb County School District which is described in subsection (b) of this40 section as being included in a particular district shall nevertheless not be included within41 such district if such part is not contiguous to such district. Such noncontiguous part shall42 instead be included within that district contiguous to such par t which contains the least43 population according to the United States decennial census of 2 020 for the State of44 Georgia."45 SECTION 2.46 Those members of the board of education of DeKalb County who are serving as such on the47 effective date of this Act and any person selected to fill a va cancy in any such office shall48 continue to serve as such members until the regular expiration of their respective terms of49 office and upon the election and qualification of their respective successors.50 SECTION 3.51 The election superintendent of DeKalb County shall call and conduct an election as provided52 in this section for the purpose of submitting this Act to the e lectors of the DeKalb County53 school district for approval or rejection. The election superi ntendent shall conduct that54 election on the Tuesday following the first Monday in November, 2026, and shall issue the55 call and conduct that election as provided by general law. The election superintendent shall56 cause the date and purpose of the election to be published once a w e e k f o r t w o w e e k s57 immediately preceding the date thereof in the official organ of DeKalb County. The ballot58 shall have written or printed thereon the words:59 "( ) YES60 61 ( ) NO62 63 Shall the Act be approved which provides that the DeKalb County Board of Education shall be composed of six members elected from one of six election districts and a chairperson elected by the voters of t he school system at large?" B. 578 - 3 - 26 LC 47 4100 All persons desiring to vote for approval of the Act shall vote "Yes," and all persons desiring64 to vote for rejection of the Act shall vote "No." If more than one-half of the votes cast on65 such question are for approval of the Act, Sections 1 and 2 of this Act shall become of full66 force and effect on January 1, 2029; provided, however, that those provisions of Section 167 necessary to conduct the 2028 election for members of the DeKal b County Board of68 Education shall become effective on January 1, 2028. If the Act is not so approved or if the69 election is not conducted as provided in this section, Sections 1 and 2 of this Act shall not70 become effective, and this Act shall be automatically repealed on the 365th calendar day71 following the election date provided for in this section. The expense of such election shall72 be borne by DeKalb County. It shall be the election superintendent's duty to certify the result73 thereof to the Secretary of State. The provisions of this section shall be mandatory upon the74 election superintendent and are not intended as directory. If the election superintendent fails75 or refuses to comply with this section, any elector of the DeKalb County school district may76 apply for a writ of mandamus to compel the election superintend ent to perform his or her77 duties under this section. If the court finds that the election superintendent has not complied78 with this section, the court shall fashion appropriate relief r equiring the election79 superintendent to call and conduct such election on the date required by this section or on the80 next date authorized for special elections provided for in Code Section 21-2-540 of the81 O.C.G.A.82 SECTION 4.83 Except as otherwise provided in Section 3 of this Act, this Act shall become effective upon84 its approval by the Governor or upon its becoming law without such approval.85 SECTION 5.86 All laws and parts of laws in conflict with this Act are repealed.87 S.
