26 LC 47 4030/AP House Bill 1452 (AS PASSED HOUSE AND SENATE) By: Representatives Cummings of the 39th, McQueen of the 61st, and Sanchez of the 42nd A BILL TO BE ENTITLED AN ACT To authorize the assessment and collection of a technology fee by the Municipal Court of the1 City of Mableton; to identify the authorized uses of such techn ology fee; to provide for2 related matters; to repeal conflicting laws; and for other purposes.3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:4 SECTION 1.5 (a) The clerk of the Municipal Court of the City of Mableton is hereby authorized to charge6 and collect a technology fee to be set by the judge of the municipal court in an amount not7 to exceed $10.00 as a surcharge to each criminal and quasi-criminal fine paid to the court. 8 Such technology fees shall be used exclusively to provide for t echnological needs of the9 Municipal Court of the City of Mableton and the city's police department. Such uses shall10 include only the following:11 (1) The purchase, lease, maintenance, and installation of computer hardware and software;12 (2) The purchase, lease, maintenance, and installation of equipment and software used for13 imaging, scanning, facsimile, communications, projections, and printing; and14 (3) Police department hardware and software, including, but no t limited to, associated15 equipment for body-worn, mobile, stationary, or vehicle mounted cameras; drones; and16 H. B. 1452 - 1 - 26 LC 47 4030/AP operations of 9-1-1 emergency response through its dedicated public safety answering point17 system.18 (b) Funds collected pursuant to this section shall be maintained in a segregated account by19 the clerk of the municipal court and the chief financial officer of the city, subject to audit by20 an auditor approved by the governing authority of the City of Mableton, and shall be used21 only for the purposes authorized in this section. Such funds may be used to reimburse the22 city's information technology department for services provided to the court or police23 department.24 SECTION 2.25 All laws and parts of laws in conflict with this Act are repealed.26 H.
