A RESOLUTION
Urging the Department of Insurance, in collaboration with the D epartment of Community1
Health, to meet with stakeholders to explore best practices in the medical surveillance of2
patients after primary therapy for breast cancer and to provide any recommendations; and for3
other purposes.4
WHEREAS, breast cancer is the second most common cancer diagnos ed in women in the5
United States and the second leading cause of death from cancer among women in the United6
States; and7
WHEREAS, the American Cancer Society estimates that, in 2026, about 2,670 men will be8
diagnosed with invasive breast cancer and about 530 men will die from breast cancer; and9
WHEREAS, depending on the individual patient and the type and s tage of breast cancer,10
treatments for breast cancer include surgery, such as a lumpect omy, breast-conserving11
surgery, mastectomy, or double mastectomy, and adjuvant therapy, such as chemotherapy,12
radiotherapy, hormone therapy, targeted therapy, or biological therapy; and13
WHEREAS, after treatments for breast cancer, medical surveillance is crucial to monitor and14
detect any local recurrence of cancer in either breast, the bre ast area, the chest wall, or15

regional lymph nodes and to monitor and detect distant metastas es or therapy related16
diseases; and 17
WHEREAS, there is debate on the cost-effectiveness, accuracy, a nd medical necessity of18
routine mammography, X-rays, ultrasounds, magnetic resonance imaging, positron emission19
tomography scans, and computed tomography scans after a mastect omy or double20
mastectomy when the patient is asymptomatic; and21
WHEREAS, a well-defined, evidence based surveillance protocol i s needed to manage22
patients with breast cancer after the initial diagnosis, during staging, after primary treatment,23
and during any follow-up care to detect early local recurrence of cancer and distant24
metastases or therapy related diseases; and25
WHEREAS, the Department of Insurance, in collaboration with the Department of26
Community Health, is in the optimal position to gather data and information from27
stakeholders, including, but not limited to, breast cancer survivors; family members of breast28
cancer survivors; medical, surgical, and radiation oncologists; radiologists; pathologists;29
other healthcare providers; and health insurers.30
NOW, THEREFORE, BE IT RESOLVED BY THE SENATE that the members of this body31
urge the Department of Insurance, in collaboration with the Dep artment of Community32
Health, to meet with stakeholders to explore best practices in the medical surveillance of33
patients after primary therapy for breast cancer and to provide any recommendations.34
BE IT FURTHER RESOLVED that the Department of Insurance shall s ubmit any35
recommendations to the chairpersons of the Senate Insurance and Labor Committee and the36
Senate Health and Human Services Committee no later than February 1, 2027, along with37

any proposed legisla tion, policy, or budget ch anges needed to i mplement such38
recommendations.39
BE IT FURTHER RESOLVED that the Secretary of the Senate is authorized and directed40
to make appropriate copies of this resolution available for distribution to the Commissioner41
of Insurance and the commissioner of the Department of Community Health.42
