26 LC 44 3307 Senate Bill 622 By: Senators Jackson of the 41st, Anderson of the 43rd, Harrell of the 40th and Parent of the 44th AS PASSED A BILL TO BE ENTITLED AN ACT To amend an Act to incorporate the City of Tucker, approved May 12, 20151 (Ga. L. 2015, p. 3897), as amended, so as to provide for the annexation of certain territory2 into the boundaries of the city; to provide for related matters; to provide for a referendum;3 to provide for a contingent effective date and automatic repeal ; to repeal conflicting laws;4 and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 An Act to incorporate the City of Tucker, approved May 12, 2015 (Ga. L. 2015, p. 3897), as8 amended, is amended by adding a new section to read as follows:9 "SECTION 1.02A.10 Additions to the corporate boundaries.11 (a)(1) In addition to the boundaries provided for in Section 1.02, there shall be included12 in the boundaries of the city all of the area embraced within the following described tracts13 and parcels of land:14 User: Tucker 15 S. B. 622 - 1 - 26 LC 44 3307 Plan Name: Tucker-Annex-2025 16 Plan Type: Local17 District ANNEX18 County DeKalb GA 19 VTD Briarlake Elem20 Block 021703 21 1013 22 VTD Midvale Road23 Block 021820 24 1000 1001 1002 1004 1005 1006 2007 25 (2) For the purposes of plan provided for in paragraph (1) of this subsection:26 (A) The term "VTD" shall mean and describe the same geographic al boundaries as27 provided in the report of the Bureau of the Census for the Unit ed States decennial28 census of 2020 for the State of Georgia. The separate numeric designations in a district29 description which are underneath a VTD heading shall mean and d escribe individual30 Blocks within a VTD as provided in the report of the Bureau of the Census for the31 United States decennial census of 2020 for the State of Georgia; and32 (B) Except as otherwise provided in the description of any dis trict, whenever the33 description of any district refers to a named city, it shall me an the geographical34 boundaries of that city a s shown on the census maps for the Uni ted States decennial35 census of 2020 for the State of Georgia.36 (b) Reserved."37 SECTION 2.38 The election superintendent of DeKalb County shall call and con duct a special election as39 provided in this section for the purpose of submitting this Act to the electors of the territory40 S. B. 622 - 2 - 26 LC 44 3307 sought to be annexed into the City of Tucker under this Act for approval or rejection. The41 election superintendent shall conduct such election on the Tuesday next following the first42 Monday in November, 2026, and shall issue the call and conduct such election as provided43 by general law. The election superintendent shall cause the date and purpose of the election44 to be published once a week for two weeks immediately preceding the date thereof in the45 official organ of DeKalb County. The ballot shall have written or printed thereon the words:46 "( ) YES47 ( ) NO48 Shall the Act which annexes certain land into the City of Tucke r be approved?" All persons desiring to vote for approval of the annexation shall vote "Yes," and all persons49 desiring to vote for rejection of the annexation shall vote "No." If more than one-half of the50 votes cast on such question are for approval of the annexation, then this Act shall become51 effective on January 1, 2027. If more than one-half of the votes cast on such question are for52 rejection of the annexation, this Act shall not become effectiv e and shall be automatically53 repealed on the first day of January immediately following such election date. The expense54 of such election shall be borne by the City of Tucker. It shall be the election superintendent's55 duty to certify the result thereof to the Secretary of State.56 SECTION 3.57 All laws and parts of laws in conflict with this Act are repealed.58 S.
