26 LC 47 4275 House Resolution 1832 By: Representatives Kelley of the 16th, Cheokas of the 151st, and Anderson of the 10th A RESOLUTION Creating the House Study Committee on the Assessment and Collec tion of Fees by Local1 Governments; and for other purposes.2 WHEREAS, Georgia counties and municipalities are constitutional ly and statutorily3 authorized to collect taxes and fees to fund the provision of local governmental services; and4 WHEREAS, local governments in Georgia have assessed and collected a wide variety of fees5 for the provision of an equally wide variety of services; and6 WHEREAS, in recent years a number of local governments have been subject to litigation7 regarding some of their fee assessment and collection practices; and8 WHEREAS, further study and evaluation of the laws, policies, an d procedures utilized in9 administering the assessment and collection of fees by local governments is warranted.10 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES:11 (1) Creation of House study committee. There is created the House Study Committee12 on the Assessment and Collection of Fees by Local Governments.13 H. R. 1832 - 1 - 26 LC 47 4275 (2) Members and officers. The committee shall be composed of five members of the14 House of Representatives to be appointed by the Speaker of the House of15 Representatives. The Speaker shall designate a member of the committee as chairperson16 of the committee.17 (3) Powers and duties. The committee shall undertake a study of the conditions, needs,18 issues, and problems mentioned above or related thereto and recommend any action or19 legislation which the committee deems necessary or appropriate.20 (4) Meetings. The chairperson shall call all meetings of the committee. The committee21 may conduct such meetings at such places and at such times as it may deem necessary or22 convenient to enable it to exercise fully and effectively its powers, perform its duties, and23 accomplish the objectives and purposes of this resolution.24 (5) Allowances and funding.25 The legislative members of the committee shall receive the allowances provided for in26 Code Section 28-1-8 of the Official Code of Georgia Annotated. T h e a l l o w a n c e s27 authorized by this resolution shall not be received by any member of the committee for28 more than five days unless additional days are authorized. Funds necessary to carry out29 the provisions of this resolution shall come from funds appropr iated to the House of30 Representatives.31 (6) Report.32 (A) In the event the committee adopts any specific findings or recommendations that33 include suggestions for proposed legislation, the chairperson shall file a report of the34 same prior to the date of abolishment specified in this resolut ion, subject to35 subparagraph (C) of this paragraph.36 (B) In the event the committee adopts a report that does not i nclude suggestions for37 proposed legislation, the chairperson shall file the report, subject to subparagraph (C)38 of this paragraph.39 H. R. 1832 - 2 - 26 LC 47 4275 (C) No report shall be filed unless the same has been approved prior to the date of40 abolishment specified in this resolution by majority vote of a quorum of the committee.41 A report so approved shall be signed by the chairperson of the committee and filed with42 the Clerk of the House of Representatives.43 (D) In the absence of an approved report, the chairperson may file with the Clerk of the44 House of Representatives a copy of the minutes of the meetings of the committee in lieu45 thereof.46 (7) Abolishment.
