26 LC 64 0115 House Resolution 1861 By: Representatives Sanchez of the 42nd, Frye of the 122nd, and Bell of the 75th A RESOLUTION Applying to the United States Congress to call a convention und er Article V of the1 Constitution of the United States limited to proposing amendments to the Constitution of the2 United States to limit the influence of money in political elec tions and on government3 officials; and for other purposes.4 WHEREAS, Article V of the Constitution of the United States req uires Congress to call a5 convention limited to proposing amendments to the Constitution upon application of6 two-thirds of the states; and7 WHEREAS, in the wake of previous scandals and public awareness of government8 corruption, the United States Congress has enacted limitations on campaign contributions and9 expenditures; and10 WHEREAS, the United States Supreme Court has struck down these limitations and failed11 to uphold convictions in public corruption cases; and12 WHEREAS, issues concerning contributions and expenditures in political elections are at an13 all-time high and have led to an increase in public distrust.14 H. R. 1861 - 1 - 26 LC 64 0115 NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL ASSEMBLY OF15 GEORGIA that this body does hereby apply to the United States C ongress to call a16 convention under Article V of the Constitution of the United States limited to proposing an17 amendment or set of amendments to the Constitution of the Unit ed States to limit the18 influence of money in political elections and on government off icials; provided, however,19 this limitation shall not prevent the consideration of comprehe nsive actions to address the20 subject, including without limitation any related limitations on the power of the United States21 Supreme Court to review any Congressionally enacted legislation authorized by such22 amendment or set of amendments.23 BE IT FURTHER RESOLVED that this application shall be considered as covering the same24 subject matter as the applications from other states to Congress to call a convention to limit25 the influence of money in political elections and on government officials; and this application26 shall be aggregated with those of other states for the purpose of attaining the two-thirds of27 states necessary to require Congress to call a limited convention on this subject, but shall not28 be aggregated with any other applications on any other subject.29 BE IT FURTHER RESOLVED that the General Assembly of Georgia ins ists that the30 convention be solely limited to strict consideration of the sub ject matter contained in this31 resolution and that the United States Congress enact a severe c riminal penalty for persons32 who violate the finite scope of the call.33 BE IT FURTHER RESOLVED that this application constitutes a continuing application in34 accordance with Article V of the Constitution of the United Sta tes of America until the35 legislatures of at least two-thirds of the several states have made applications on the same36 subject.37 H. R. 1861 - 2 - 26 LC 64 0115 BE IT FURTHER RESOLVED that the Clerk of the House of Representatives is authorized38 and directed to make appropriate copies of this resolution avai lable for distribution to the39 President and Secretary of the Senate of the United States; to the Speaker, Clerk, and40 Judiciary Committee Chairperson of the House of Representatives of the United States; to41 members of the General Assembly of Georgia; and to the presiding officers of each of the42 legislative houses in the several states, requesting their cooperation.43 H.
