26 LC 64 0128S The House Committee on Special Rules offers the following substitute to HR 1891: A RESOLUTION Creating the House Study Committee on Physicians' Delegation Authority and Supervision1 of Georgia's Advanced Practice Providers; and for other purposes.2 WHEREAS, there are currently more than 25,000 authorized nurse protocol agreements and3 more than 1,000 different physician assistant job descriptions in Georgia; and4 WHEREAS, the Georgia Composite Medical Board continues to modif y the protocol5 agreement and job descriptions for physician assistants in an effort to enhance the approval6 process; and7 WHEREAS, advanced practice registered nurses are licensed under the Georgia Board of8 Nursing with protocol agreements being processed by the Georgia Composite Medical9 Board; and10 WHEREAS, several laws affecting nurse protocol agreements canno t be executed due to11 challenges relating to policies and procedures implemented by t he Georgia Composite12 Medical Board and the Georgia Board of Nursing; and13 H. R. 1891 (SUB) - 1 - 26 LC 64 0128S WHEREAS, limited training and education is provided for nurses, physician assistants, and14 physicians relative to the approval, processing, and administra tion of nurse protocol15 agreements and job descriptions of a physician assistant; and16 WHEREAS, there is a demand for available physicians willing to enter into advanced17 practice registered nurse protocol agreements and physician assistant job descriptions; and18 WHEREAS, there continues to be scope of practice and public pol icy changes impacting19 advanced practice providers being considered by the legislature.20 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES:21 (1) Creation of House study committee. There is created the House Study Committee22 on Physicians' Delegation Authority and Supervision of Georgia' s Advanced Practice23 Providers.24 (2) Members and officers. The committee shall be composed of nine members as25 follows:26 (A) Three members of the House of Representatives to be appoin ted by the Speaker27 of the House of Representatives;28 (B) An advanced practice registered nurse licensed in the Stat e of Georgia who is29 operating with an approved nurse protocol agreement; 30 (C) A physician licensed in the State of Georgia who is operat ing with an advanced31 practice registered nurse who has an approved nurse protocol agreement;32 (D) A physician assistant licensed in the State of Georgia who is operating with an33 approved job description;34 (E) A member designated by the Georgia Board of Nursing; 35 (F) A member designated by the Georgia Composite Medical Board; and36 (G) The commissioner of community health or his or her designee.37 H. R. 1891 (SUB) - 2 - 26 LC 64 0128S The Speaker shall designate a legislative member of the committee as chairperson of the38 committee.39 (3) Powers and duties. The committee shall undertake a study of the conditions, needs,40 issues, and problems mentioned above or related thereto and recommend any action or41 legislation which the committee deems necessary or appropriate.42 (4) Meetings. The chairperson shall call all meetings of the committee. The committee43 may conduct such meetings at such places and at such times as it may deem necessary or44 convenient to enable it to exercise fully and effectively its powers, perform its duties, and45 accomplish the objectives and purposes of this resolution.46 (5) Allowances, expenses, and funding.47 (A) The legislative members of the committee shall receive the allowances provided48 for in Code Section 28-1-8 of the Official Code of Georgia Annotated.49 (B) Members of the committee who are state officials, other than legislative members,50 or who are state employees shall receive no compensation for th eir services on the51 committee, but they may be reimbursed for expenses incurred by them in the52 performance of their duties as members of the committee in the same manner as they53 are reimbursed for expenses in their capacities as state officials or employees.54 (C) Members of the committee who are not legislators, state of ficials, or state55 employees shall receive a daily expense allowance in an amount the same as that56 specified in subsection (b) of Code Section 45-7-21 of the Offi cial Code of Georgia57 Annotated, as well as the mileage or transportation allowance a uthorized for state58 employees.59 (D) The allowances authorized by this resolution shall not be received by any member60 of the committee for more than five days unless additional days are authorized. Funds61 necessary to carry out the provisions of this resolution shall come from funds62 appropriated to the House of Representatives; except that funds for the reimbursement63 of the expenses of state officials, other than legislative memb ers, and for the64 H. R. 1891 (SUB) - 3 - 26 LC 64 0128S reimbursement of the expenses of state employees shall come from funds appropriated65 to or otherwise available to their respective agencies.66 (6) Report.67 (A) In the event the committee adopts any specific findings or recommendations that68 include suggestions for proposed legislation, the chairperson shall file a report of the69 same prior to the date of abolishment specified in this resolut ion, subject to70 subparagraph (C) of this paragraph.71 (B) In the event the committee adopts a report that does not i nclude suggestions for72 proposed legislation, the chairperson shall file the report, subject to subparagraph (C)73 of this paragraph.74 (C) No report shall be filed unless the same has been approved prior to the date of75 abolishment specified in this resolution by majority vote of a quorum of the committee.76 A report so approved shall be signed by the chairperson of the committee and filed with77 the Clerk of the House of Representatives.78 (D) In the absence of an approved report, the chairperson may file with the Clerk of the79 House of Representatives a copy of the minutes of the meetings of the committee in lieu80 thereof.81 (7) Abolishment.
